2 <br />REGULAR MEETING MAY 11 1987 <br />yard within One Thousand (1,000) feet of, but not closer than Five Hundred (500) <br />feet of, the Zoning Use Districts listed in Section 4- 51(d)(2) of the South Bend <br />Municipal Code; and <br />WHEREAS, the South Bend Scrap and Processing Division desires to continue to <br />operate the Prairie Avenue scrap yard within One Thousand (1,000) feet of, but not <br />closer than Five Hundred (500) feet of, said Zoning Use Districts. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />SECTION I. That the license applications for the following be approved based <br />upon the satisfactory review of the properties by the Department of Code Enforcement <br />and the Fire Department Prevention Bureau, inspections having been made in April, <br />1987, and subsequent favorable recommendation by the Board of Public Works: <br />South Bend Scrap and Processing Div. 3113 S. Gertrude <br />of Sturgis Iron & Metal Co., Inc. <br />South Bend Scrap and Processing Div. 1305 Prairie Ave. <br />of Sturgis Iron & Metal Co., Inc. <br />SECTION II. That the operation of the scrap yard at the Prairie Street <br />property shall be subject to the following conditions: <br />(a) That no shredders shall be allowed to operate at <br />this location. <br />(b) That no sheerer in excess of 1,100 tons shall be <br />allowed to operate at this location. <br />(c) That permanent underground containers of suitable <br />material be housed on this location for all oils, <br />solvents, and other fluids drained at this facility. <br />SECTION III. That the One Thousand (1,000) foot distance restriction set forth <br />in Section 4- 51(d)(2) of the South Bend Municipal Code is hereby waived as to the <br />property located at 1305 Prairie Avenue in order to permit the operation of a scrap <br />yard within One Thousand (1,000) feet of, but no closer than Five Hundred (500) feet <br />of, the Zoning Use Districts set forth in Section 4- 51(d)(2) of the South Bend <br />Municipal Code. <br />SECTION IV. No licenses shall be issued by the City Controller for the above <br />properties until after the sale of the properties by Metal Resources Corporation to <br />Sturgis Iron and Metal Co., Inc., which is to occur on or about May 15, 1987. <br />SECTION V. This Resolution shall be in full force and effect from and after <br />its adoption by the Common Council and approval by the Mayor. <br />/S/ Joseph T. Council Member Voorde <br />made a motion to accept the substitute bill on file with the City Clerk, seconded by <br />Council Member Taylor. The motion carried. Patricia DeClercq, Director of Code <br />Enforcement, indicated all inspections had been made of this property and the Board <br />of Works was recommending the approval of licenses for 1987. Bruce Bancroft, <br />attorney, for South Bend Scrap and Processing Div., of Sturgis Iron & Metal Company, <br />indicated they were purchasing these properties from Metal Resources Corporation. <br />He indicated they would operate the properties in accordance with the Municipal Code <br />requirements. Council Member Taylor made a motion to adopt this resolution, <br />seconded by Council Member Beck. The resolution was adopted by a roll call vote of <br />seven ayes and two nays, (Council Members Barcome and Paszek). <br />RESOLUTION NO. 1503 -87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY <br />KNOWN AS THE SOUTHEAST CORNER OF ST. LOUIS AND WAYNE <br />STREETS AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF <br />REAL PROPERTY TAX ABATEMENT. <br />WHEREAS, a petition for real property tax abatement consideration has been filed <br />with the Common Council of the City of South Bend, requesting that the area commonly <br />known as the Southeast Corner of St. Louis and Wayne Streets, South Bend, Indiana, <br />and which is more particularly described by a line drawn as follows: <br />A parcel of land being a part of the Northeast Quarter of Section 12, Township <br />37 north, Range 2 East, City of South Bend, Portage Township, St. Joseph County, <br />Indiana and being more particularly described as follows: <br />
