273 <br />OF THE FIRST NORTH -SOUTH ALLEY EAST OF S. DALE STREET FOR A <br />DISTANCE OF APPROXIMATELY 268 FEET AND A WIDTH OF 14 FEET. PART <br />LOCATED IN LINDBERGH PARK ADDITION IN THE CITY OF SOUTH BEND, <br />INDIANA. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Slavinskas <br />reported that the Zoning and Vacation Committee had met on this bill and had no <br />recommendation. Dar Dobbins, 1017 E. Eckman, made the presentation for the bill. <br />He indicated this alley had not been used for through traffic for 25 years. He <br />indicated that a new neighbor wanted this alley open. He indicated they felt that <br />for crime and safety reasons this alley should be kept closed. Candy Howell, 921 E. <br />Eckman, presented a petition with 16 signatures to keep the alley as it is now. Ted <br />Hengesbach, 2709 Miami, spoke in favor of the vacation. Richard Cook, attorney, <br />spoke against this petition. He presented a petition in support of objection to <br />vacating alley, signed by Kenneth & Sheila Klockow. Lauren Kessler 1006 Irvington, <br />spoke against vacating this alley, since she has a garage located on the alley. <br />Council Member Washington made a motion to continue this bill indefinitely, seconded <br />by Council Member Slavinskas. The motion carried. <br />BILL NO. 49 -92 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST <br />EAST /WEST ALLEY NORTH OF EAST COLFAX AVENUE (U.S. 20) FROM THE <br />WEST RIGHT -OF -WAY LINE OF NORTH FRANCES STREET TO THE EAST <br />RIGHT -OF -WAY LINE OF EDMOND COURT FOR A DISTANCE OF APPROXIMATELY <br />165 FEET AND A WIDTH OF APPROXIMATELY 10 FEET. PART SITUATED IN <br />COTTRELL'S FIRST ADDITION IN THE CITY OF SOUTH BEND, INDIANA. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Slavinskas <br />reported that the Zoning and Vacation Committee had met on this bill and recommended <br />it to the Council favorable. Council Member Luecke made a motion to accept the <br />substitute bill on file with the City Clerk, seconded by Council Member Coleman. <br />The motion carried. Council Member Ladewski stated he was an employee of the South <br />Bend Clinic and he would abstain from voting on this bill. Rick Morgan, attorney, <br />made the presentation for the bill. He indicated the South Bend Clinic was asking <br />for this vacation in order to expand their parking lot. Council Member Coleman made <br />a motion to recommend this bill to the Council favorable, as amended, seconded by <br />Council Member Duda. The motion carried. <br />BILL NO. 42 -92 <br />A BILL TRANSFERRING $33,500 WITHIN ACCOUNTS WITHIN THE DEPARTMENT <br />OF ECONOMIC DEVELOPMENT. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Slavinskas <br />reported that the Human Resources Committee had met on this bill and recommended it <br />to the Council favorable. Beth Leonard, director of Financial and Program <br />Management, made the presentation for the bill. She indicated this bill would <br />transfer monies into Northeast Neighborhood Planning; Workforce Development <br />Services; Manufacturing Technology Center; and MACOG. Council Member Coleman made a <br />motion to recommend this bill to the Council favorable, seconded by Council Member <br />Ladewski. The motion carried. <br />BILL NO. 44 -92 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE ENTITLED <br />"ZONING ". <br />II This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Slavinskas <br />reported that the Zoning and Vacation Committee had met on this bill and recommended <br />it to the Council favorable. John Byorni, Area Plan, made the presentation for the <br />bill. He indicated that Area Plan had initiated this petition to amend the "A -3" <br />Mixed Use Zoning to better identify permitted retail business uses. He indicated <br />that at the present time clubs are not included as permitted uses, but other similar <br />uses are allowed, and this bill would allow clubs within A -3 zoning. Council Member <br />Slavinskas made a motion to recommend this bill to the Council favorable, seconded <br />by Council Member Zakrzewski. The motion carried. <br />BILL NO. 45 -92 <br />A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND AMENDING <br />CHAPTER 2 OF THE SOUTH BEND MUNICIPAL CODE. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Slavinskas <br />reported that the Human Resources Committee had met on this bill and recommended it <br />to the Council favorable, as amended. He made a motion to accepted the amended bill <br />on file with the City Clerk, seconded by Council Member Washington. The motion <br />carried. Aladean DeRose, attorney for Human Rights, made the presentation for the <br />bill. She indicated new legislation prohibiting housing discrimination based on the <br />Fair Housing Act has been enacted. She indicated the present ordinance prohibits <br />handicapped discrimination in housing, but does not include familial status based <br />discrimination or the full range of prohibited acts of discrimination in housing. <br />She indicated this bill would define terms adopted by Federal and State law, as well <br />as define the prohibited acts of discrimination, seeks to enlarge compensatory <br />damages in employment discrimination cases. Council Member Coleman made a motion to <br />recommend this bill to the Council favorable, seconded by Council Member Ladewski. <br />The motion carried. <br />
