West along the North line of said Quarter Section, 1305.00 feet; thence South 00 °00'23" West along the centerline of Kenmore Street, 363.70 feet; thence South 09 °59137" East along said centerline, 486.87 feet to the centerline intersection of Kenmore street and McGill Street; thence South 80 °00123" West along the centerline of McGill Street, 303.50 feet; thence North 89 °59137" West along said centerline, 270.66 feet to the Point of Beginning; thence South 00 °00'00" West, 401.41 feet; thence North 89 °50'37" West, 523.60 feet; thence North 00 °02141" East, 401.40 feet; thence South 89 °59137" West, 523.23 feet to the Point of Beginning, and containing 4.823 acres more or less and is subject to all easements, restrictions, and or limitations of record. with said real estate having the following Key No. 25 500 5059, as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6- 1.1- 12- .1 -2.5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. Now, therefore, be it resolved by the Common Council of the City of South Bend, Indiana, as follows. Section I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for Personal Property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. Section II. The Common Council hereby determines that the property owner is qualified for and is granted real property tax deduction for a period of five (5) years, and further determines that the petition complies with Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6 -1.1 -12.1 et seq. Section III. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /S/ Stephen Luecke Member of the Common Council A public hearing was held on the resolution at this time. Robert Voss, Controller for Bangor Refrigeration, made the presentation. He indicated they were upgrading their machinery in order to be more competitive. He indicated they planned to add 30 new jobs with this upgrade. Council Member Coleman made a motion to adopt this resolution, seconded by Council Member Puzzello. The resolution was adopted by a roll call vote of nine ayes. BILLS, FIRST READING BILL NO. 15 -92 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 630 W. WASHINGTON STREET AND 124 S. SCOTT STREET IN THE CITY OF SOUTH BEND, INDIANA. This bill had first reading. Council Member Coleman made a motion to refer this bill to Area Plan, seconded by Council Member Duda. The motion carried. BILL NO. 16 -92 A BILL APPROPRIATING $42,706.00 FROM THE EQUAL EMPLOYMENT OPPORTUNITY COMMISSION FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE SOUTH BEND HUMAN RIGHTS COMMISSION OF THE CITY OF SOUTH BEND, INDIANA FOR THE YEAR BEGINNING OCTOBER 1, 1991 AND ENDING SEPTEMBER 30, 1992. This bill had first reading. Council Member Coleman made a motion to refer this bill to the Human Resources Committee and set it for third reading and public hearing on February 24, seconded by Council Member Duda. The motion carried. PRIVILEGE OF THE FLOOR Lee Brummett, 1129 Diamond, spoke against Local Option Tax. There being no further business to come before the Council unfinished or new, Council Member Coleman made a motion to adjourn, seconded by Council Member Ladewski.
