The City wishes to acknowledge publicly the pro bono assistance <br />provided by the Law Firm of Barnes & Thornburg through its attorney Adam Milani, who <br />has assisted Don Fozo, the Building Commissioner for the City of South Bend and St. <br />Joseph County, and John Embrickson, the "responsible employee" for ADA compliance <br />for St. Joseph County; as we work together to meet all of those compliance <br />reqirements of the Americans With Disabilities Act. <br />SECTION IV. He indicated this resolution officially appoints the <br />"Responsible Employee" for the City who will oversee ADA compliance. Council Member <br />Coleman made a motion to adopt the resolution, seconded by Council Member Ladewski. <br />The resolution was adopted by a roll call vote of nine ayes <br />BILLS, FIRST READING <br />BILL NO. 10 -92 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED A 3207 <br />SOUTH HIGH STREET, IN THE CITY OF SOUTH BEND, INDIANA. <br />This bill had first reading. Council Member Coleman made a motion to refer this <br />bill to Area Plan, seconded by Council Member Duda. The motion carried. <br />BILL NO. 11 -92 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: WEST <br />JEFFERSON STREET FROM THE WEST LINE OF LOT #32 RUNNING EAST TO 40 <br />FEET EAST OF THE EAST LINE OF LOT #29 IN ANN THOMAS SUBDIVISION <br />TO THE CITY OF SOUTH BEND, INDIANA, FOR A DISTANCE OF <br />APPROXIMATELY 270 FEET. <br />This bill had first reading. Council Member Puzzello made a motion to refer this <br />bill to the Zoning and Vacation Committee and set it for public hearing and third <br />reading February 10, seconded by Council Member Coleman. The motion carried. <br />BILL NO. 12 -92 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING CHAPTER 2, ARTICLE 4, SECTION 2 -13 OF THE MUNICIPAL CODE <br />TO ESTABLISH A CITY BUILDING DEPARTMENT AND TO ENUMERATE CERTAIN <br />FUNCTIONS OF THAT DEPARTMENT. <br />This bill had first reading. Council Member Coleman made a motion to refer this <br />bill to the Personnel and Finance Committee and set it for public hearing and third <br />reading February 10, seconded by Council Member Coleman. The motion carried. <br />BILL NO. 13 -92 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />CONCERNING THE TRANSFER OF PARK PROPERTY TO THE SOUTH BEND <br />COMMUNITY SCHOOL CORPORATION. <br />This bill had first reading. Council Member Slavinskas reported that the Zoning and <br />Vacation Committee had met on this bill and recommended it to the Council <br />favorable. Council Member Slavinskas made a motion to set it for public hearing and <br />third reading February 3, seconded by Council Member Coleman. The motion carried. <br />Council Member Slavinskas made a motion to suspend the rules and have first reding <br />on Bill No. 14 -92, seconded by Council Member Coleman. The motion carried on a roll <br />call vote of nine ayes. <br />BILL NO. 14 -92 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATION AT THE <br />SOUTHWEST CORNER OF PORTAGE ROAD AND THE EAST -WEST TOLL ROAD IN <br />THE CITY OF SOUTH BEND, INDIANA. <br />This bill had first reading. Council Member Slavinskas made a motion to refer this <br />bill to Area Plan, seconded by Council Member Coleman. The motion carried. <br />
