15 <br />REGULAR MEETING <br />JUNE 24, 1991 <br />be employed or whose employment will be retained can be reasonably <br />expected to result from the proposed installation of new equipment; <br />(d) any other benefits about which information was requested are <br />benefits that can be reasonably expected to result from the proposed <br />installation of new manufacturing equipment; and <br />(e) the totality of benefits is sufficient to justify the deduction <br />requested <br />SECTION II. The Common Council hereby determines and finds that the proposed new <br />manufacturing equipment can be reasonably expected to yield the benefits identified <br />in the Statement of Benefits as set forth in Section 1 through 3 of the Petition for <br />Personal Property Tax Abatement consideration and that the Statement of Benefits <br />Form completed by the Petitioner, said form being prescribed by the State Board of <br />Accounts are sufficient to justify the deduction granted under Indiana Code <br />6 -1.1- 12.1 -4.5. <br />SECTION III. The Common Council hereby accepts the report and recommendation of the <br />Department of Economic Development, and the Human Resources and Economic Development <br />Committee's favorable recommendation, that the area herein described be designated <br />as Economic Revitalization Area for purposes of personal property tax abatement and <br />hereby makes such a designation. <br />SECTION IV. The Common Council determines that such designation is for personal <br />property tax abatement only and shall be limited to two (2) calendar years from the <br />date of the adoption of this Resolution by the Common Council. <br />SECTION V. The Common Council hereby determines that the property owner is <br />qualified for and is granted property tax deduction for a period of five (5) years. <br />SECTION VI. The Common Council directs the City Clerk to cause notice of the <br />adoption of this Declaratory Resolution to be published pursuant to Indiana Code <br />5 -3 -1, said publication providing notice of the public hearing before the Common <br />Council on said declaration. <br />SECTION IX. This Resolution shall be in full force and effect from and after its <br />adoption by the Common Council and approval by the Mayor. <br />/s/ Donald Niezgodski <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Council Member Luecke <br />reported that the Human Resources Committee met on this bill and recommended it to <br />the Council favorably. John Sullivan, 2905 Indian Lake Road, Niles, made the <br />presentation for the resolution. He indicated they planned to purchase net <br />equipment to make plastic fuel tanks. He indicated Solvay supplies Ford, Chrysler <br />and G.M. with fuel tanks and is one of the largest manufacturing plans of plastic <br />fuel tanks in the U.S. Council Member Slavinskas indicated he had discussed his <br />company's connection with Solvay, with the Council attorney and since he would not <br />benefit from the action of the Council he could vote on his resolution. Council <br />Member Coleman made a motion to adopt this resolution, seconded by Council Member <br />Ladewski. The resolution was adopted by a roll call vote of nine ayes. <br />ig1Q <br />RESOLUTION NO. 8179 -91 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, AUTHORIZING THE MAYOR TO SUBMIT TO THE <br />DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT AN APPLICATION <br />FOR THE RENTAL REHABILITATION PROGRAM AND FOR THE SOUTH BEND <br />PUBLIC HOUSING AUTHORITY TO SUBMIT AN APPLICATION FOR <br />SECTION 8 HOUSING SUBSIDY. <br />WHEREAS, the Mayor of the City of South Bend, Indiana, is the Chief Executive <br />Officer of the City and is the applicant for funds made available through the United <br />States Housing Act (the Act). The Rental Rehabilitation Program is authorized by <br />Section 17 of the Act which was enacted into law in Section 301 of the Housing and <br />Urban -Rural Recovery Act of 1983; and <br />WHEREAS, Section 8 of the United States Housing Act of 1937, as amended, <br />authorizes the Housing Authority to develop, own, or assist in housing which is not <br />being provided by the private sector; and <br />WHEREAS, there currently exists in South Bend, Indiana, a need for housing which <br />is not being provided by the private sector; and <br />WHEREAS, the U.S. Department of Housing and Urban Development available funds <br />for such purpose. <br />NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South Bend, <br />Indiana. <br />SECTION I. That the Mayor of the City of South Bend, Indiana, is hereby <br />authorized to submit the Rental Rehabilitation application to the United States <br />Department of Housing and Urban Development. <br />
