)10 REGULAR MEETING JUNE 10, 1991 October 9, 1990. Under this agreement, mental health services will be provided by Madison Center to St. Joseph County, and the County shall pay for such services pursuant to an additional County tax levy. Due to the relationship between Madison Center and the County with respect to said facilities, this Common Council wishes to transfer jurisdiction over said health care facilities and the financing thereof pursuant to the Act to St. Joseph County. IND. Code Sec. 36- 7- 12 -22(b) provides in relevant part that "....economic development facilities that are to be located within the corporate boundaries of a municipality may not be financed by a County without the consent of the fiscal body of the municipality... ". NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, The the Common Council consents, pursuant to the provisions of IND. CODE Sec.36- 7- 12- 22(B), to the financing of said health care facilities by St. Joseph County, Indiana and its Economic Development Commission, and jurisdiction with respect thereto is hereby transferred to St. Joseph County, Indiana. This Resolution shall be in full force and effect immediately upon its adoption by the Common Council and approval by the Mayor /s /Donald Niezgodski Member of the Common Council A public hearing was held on the resolution at this time. Council Member Luecke reported that the Human Resources Committee had met on this bill and recommended it favorably to the Council. Richard Morgan, attorney, made the presentation for the resolution. He indicated Council approval was necessary for the County to sell economic development revenue bonds to finance construction of an inpatient mental health facility at Madison Center. He indicated this facility will provide mental health services, regardless of the ability to pay, that is not currently available in the County. Council Member Soderberg made a motion to adopt this resolution, seconded by Council Member Ladewski. The resolution was adopted by a roll call vote of nine ayes. BILLS, FIRST READING BILL NO. 33 -91 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1950 RIDGEDALE ROAD IN THE CITY OF SOUTH BEND, INDIANA. This bill had first reading. Council Member Zakrzewski made a motion to refer this bill to Area Plan, seconded by Council Member Coleman. The motion carried. BILL NO. 34 -91 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED GENERALLY BETWEEN CORBY STREET ON THE NORTH AND THE FIRST EAST -WEST ALLEY NORTH OF CEDAR STREET ON THE SOUTH AND ON BOTH SIDES OF NILES AVENUE. This bill had first reading. Council Member Coleman made a motion to refer this bill to Area Plan, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 35 -91 A BILL AMENDING THE ZONING ORDINANCE FOR THE WEST WASHINGTON - CHAPIN DEVELOPMENT AREA OF THE CITY OF SOUTH BEND, INDIANA. This bill had first reading. Council Member Coleman made a motion to refer this bill to Area Plan, seconded by Council Member Luecke. The motion carried. BILL NO. 36 -91 A BILL APPROPRIATING $581,100 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE DEPARTMENT OF ECONOMIC DEVELOPMENT OF THE CITY OF SOUTH BEND, INDIANA, AND DESIGNATED SUBGRANTEE AGENCIES FOR THE PROGRAM YEAR BEGINNING JANUARY 1, 1991 TO BE ADMINISTERED THROUGH THE DEPARTMENT OF ECONOMIC DEVELOPMENT. This bill had first reading. Council Member Luecke made a motion to refer this bill to the Human Resources Committee and set it for public hearing and third reading on June 24, seconded by Council Member Coleman. The motion carried. BILL NO. 37 -91 A BILL APPROPRIATING $127,832 AMONG VARIOUS ACCOUNTS WITHIN THE DEPARTMENT OF ECONOMIC DEVELOPMENT. This bill had first reading. Council Member Luecke made a motion to refer this bill to the Human Resources Committee and set it for public hearing and third reading on June 24, seconded by Council Member Coleman. The motion carried. BILL NO. 38 -91 A BILL APPROPRIATING $1,302,600.00 FROM THE LOCAL ROAD AND STREET FUND FOR THE 1991 PUBLIC WORKS PROGRAM AND REDUCING APPROPRIATIONS ON VARIOUS CLOSED PROJECTS. This bill had first reading. Council Member Zakrzewski made a motion to refer this bill to the Public Works Committee and set it for public hearing and third reading on June 24, seconded by Council Member Coleman. The motion carried.
