)10 <br />REGULAR MEETING <br />JUNE 10, 1991 <br />October 9, 1990. Under this agreement, mental health services will be provided by <br />Madison Center to St. Joseph County, and the County shall pay for such services <br />pursuant to an additional County tax levy. <br />Due to the relationship between Madison Center and the County with respect to <br />said facilities, this Common Council wishes to transfer jurisdiction over said <br />health care facilities and the financing thereof pursuant to the Act to St. Joseph <br />County. IND. Code Sec. 36- 7- 12 -22(b) provides in relevant part that "....economic <br />development facilities that are to be located within the corporate boundaries of a <br />municipality may not be financed by a County without the consent of the fiscal body <br />of the municipality... ". <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, The the Common Council consents, pursuant to the provisions of IND. CODE <br />Sec.36- 7- 12- 22(B), to the financing of said health care facilities by St. Joseph <br />County, Indiana and its Economic Development Commission, and jurisdiction with <br />respect thereto is hereby transferred to St. Joseph County, Indiana. <br />This Resolution shall be in full force and effect immediately upon its adoption <br />by the Common Council and approval by the Mayor <br />/s /Donald Niezgodski <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Council Member Luecke <br />reported that the Human Resources Committee had met on this bill and recommended it <br />favorably to the Council. Richard Morgan, attorney, made the presentation for the <br />resolution. He indicated Council approval was necessary for the County to sell <br />economic development revenue bonds to finance construction of an inpatient mental <br />health facility at Madison Center. He indicated this facility will provide mental <br />health services, regardless of the ability to pay, that is not currently available <br />in the County. Council Member Soderberg made a motion to adopt this resolution, <br />seconded by Council Member Ladewski. The resolution was adopted by a roll call vote <br />of nine ayes. <br />BILLS, FIRST READING <br />BILL NO. 33 -91 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1950 <br />RIDGEDALE ROAD IN THE CITY OF SOUTH BEND, INDIANA. <br />This bill had first reading. Council Member Zakrzewski made a motion to refer this <br />bill to Area Plan, seconded by Council Member Coleman. The motion carried. <br />BILL NO. 34 -91 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED <br />GENERALLY BETWEEN CORBY STREET ON THE NORTH AND THE FIRST <br />EAST -WEST ALLEY NORTH OF CEDAR STREET ON THE SOUTH AND ON BOTH <br />SIDES OF NILES AVENUE. <br />This bill had first reading. Council Member Coleman made a motion to refer this <br />bill to Area Plan, seconded by Council Member Zakrzewski. The motion carried. <br />BILL NO. 35 -91 A BILL AMENDING THE ZONING ORDINANCE FOR THE WEST <br />WASHINGTON - CHAPIN DEVELOPMENT AREA OF THE CITY OF SOUTH BEND, <br />INDIANA. <br />This bill had first reading. Council Member Coleman made a motion to refer this <br />bill to Area Plan, seconded by Council Member Luecke. The motion carried. <br />BILL NO. 36 -91 A BILL APPROPRIATING $581,100 FROM THE COMMUNITY DEVELOPMENT <br />BLOCK GRANT FUND FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE <br />DEPARTMENT OF ECONOMIC DEVELOPMENT OF THE CITY OF SOUTH BEND, <br />INDIANA, AND DESIGNATED SUBGRANTEE AGENCIES FOR THE PROGRAM YEAR <br />BEGINNING JANUARY 1, 1991 TO BE ADMINISTERED THROUGH THE <br />DEPARTMENT OF ECONOMIC DEVELOPMENT. <br />This bill had first reading. Council Member Luecke made a motion to refer this bill <br />to the Human Resources Committee and set it for public hearing and third reading on <br />June 24, seconded by Council Member Coleman. The motion carried. <br />BILL NO. 37 -91 A BILL APPROPRIATING $127,832 AMONG VARIOUS ACCOUNTS WITHIN THE <br />DEPARTMENT OF ECONOMIC DEVELOPMENT. <br />This bill had first reading. Council Member Luecke made a motion to refer this bill <br />to the Human Resources Committee and set it for public hearing and third reading on <br />June 24, seconded by Council Member Coleman. The motion carried. <br />BILL NO. 38 -91 A BILL APPROPRIATING $1,302,600.00 FROM THE LOCAL ROAD AND STREET <br />FUND FOR THE 1991 PUBLIC WORKS PROGRAM AND REDUCING <br />APPROPRIATIONS ON VARIOUS CLOSED PROJECTS. <br />This bill had first reading. Council Member Zakrzewski made a motion to refer this <br />bill to the Public Works Committee and set it for public hearing and third reading <br />on June 24, seconded by Council Member Coleman.
