is both adequately sized to house all of the City's vehicle repair and maintenance <br />operations, and which shall be properly ventilated and otherwise equipped. <br />4. That the City owns an adequately sized facility at 1045 West Sample Street, <br />formerly known as the National Mill Supply Warehouse which facility can and should <br />be renovated to accommodate the City's vehicle maintenance needs. <br />5. That on the 3rd day of December, 1990, a petition signed by fifty (50) <br />taxpayers of the City of South Bend, Indiana, was filed with the Board of Public <br />Works of the City of South Bend, Indiana requesting that it acquire a vehicle <br />maintenance facility by entering into a lease /purchase agreement with Liberty <br />National Leasing Company, of Louisville, Kentucky, for a term of ten (10) years, <br />with the cost of land acquisition and renovation of said facility by said <br />corporation not to exceed two million dollars ($2,000,000.00). <br />6. That on the 3rd day of December, 1990 the Board <br />certificate signed by the St. Joseph County Auditor, <br />and the signatories of the petition are taxpayers of <br />corporate limits of the City of South Bend. <br />of Public Works received a <br />certifying that the verifier <br />property located within the <br />7. That on the 3rd day of December, 1990, plans, specifications and cost estimates <br />for the renovation of the facility at 1045 West Sample as a centralized vehicle <br />maintenance facility were filed with the Board of Public Works. <br />8. That having heard all speakers at the presentation and hearing on this <br />resolution on this 10th day of December, 1990, and having taken into consideration <br />facts adduced at this hearing and in documents and presentations, as well as all <br />personal investigation, discussions and consideration by individual Council <br />Members, the South Bend Common Council hereby finds, pursuant to I.C. 36- 1 -10 -7 <br />(2), that the acquisition of a vehicle maintenance facility by lease /purchase, as <br />petitioned by the fifty (50) taxpayers of the City of South Bend, as certified by <br />the St. Joseph County Auditor, is needed. <br />9. This resolution shall be in full force and effect from and after its adoption <br />by the Common Council and approval by the Mayor. <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Jenny Pitts - Manier, <br />_ Assistant City Attorney, made the presentation on the bill. She indicated that the <br />resolution states that it is necessary to lease /purchase the vehicle maintenance <br />facility. She stated that this resolution is another step in the process of <br />acquiring and renovating the property located at 1045 W. Sample St., to be used as <br />a centralized vehicle maintenance facility. Council Member Coleman made a motion <br />to adopt this resolution, seconded by Council Member Luecke.
