REGULAR MEETING APRIL 14,1997 <br />A DECLARATORY RESOLUTION DESIGNATING <br />CERTAIN AREAS WITHIN THE CITY OF SOUTH <br />BEND, INDIANA, COMMONLY KNOWN AS 250 <br />EAST SAMPLE STREET TO BE AN ECONOMIC <br />REVITALIZATION AREA FOR PURPOSES OF A <br />SIX (6) YEAR REAL PROPERTY TAX ABATEMENT <br />FOR THE SOUTH BEND REDEVELOPMENT <br />COMMISSION FOR THE BENEFIT OF: DAVIS <br />AND GROOME, AN INDIANA PARTNERSHIP <br />WHEREAS, the Common Council of the City of South Bend, Indiana, <br />has adopted a Declaratory Resolution designating certain areas <br />within the City as Economic Revitalization Areas for the purpose <br />of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly <br />known as 250 E. Sample, South Bend IN, and which is particularly <br />described as follows: <br />Parcel I: Lots numbered one (1), two (2) and three (3) as <br />shown on the recorded plat of Mary Hutchins' addition to the <br />City of South Bend, recorded in Plat Book 2, Page 67, <br />together with the east and west alley lying of lots 1 and 2 <br />and north of lot 3 of said lots. <br />A lot or parcel of land in the east half of the northwest <br />quarter of Section 13, Township 37 north, Range 2 east, now <br />within and a part of the City of South Bend, in St. Joseph <br />County, Indiana, described as beginning at a point 36 rods, <br />3 feet and 10 inches west of the northeast corner of the <br />northwest quarter of said section 13; thence running west on <br />the north line of said section a distance of 28 feet; thence <br />to the place of beginning, excepting therefrom that part <br />taken off of the north end thereof for Sample Street. <br />Parcel II: A parcel of land in the northwest quarter of <br />Section 13, Township 37 north, Range 2 east, described as <br />follows: Beginning at a point 40 rods, 13 feet and 10 <br />inches west of the northeast corner of the northwest quarter <br />of the northwest quarter of section 13, which point is in <br />the center line of Sample Street; thence east on said line <br />48 feet; thence South 10 rods and 31 links; thence west 43 <br />feet; thence north 10 rods and 31 links to the place of <br />beginning. <br />with said real estate having the following Key Number 18 7001 <br />0001, 18 7001 0002, and 18 7008 0277 an Economic Revitalization <br />Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and <br />the public hearing before the Council has been published pursuant <br />to Indiana Code 6 -1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of <br />hearing all remonstrances and objections from interested persons; <br />and <br />WHEREAS, the Council has determined that the qualifications for <br />an economic revitalization area have been met. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City <br />of South Bend, Indiana, as follows: <br />SECTION I. The Common Council hereby confirms its Declaratory <br />Resolution designating the area described herein as an Economic <br />Revitalization Area for the purposes of tax abatement. Such <br />designation is for Real property tax abatement only and is <br />limited to two (2) calendar years from the date of adoption of <br />the Declaratory Resolution by the Common Council. <br />1 <br />1 <br />1 <br />
