REGULAR MEETING JUNE 22, 1998 <br />public hearing held June 4, 1998, for their comments; and <br />WHEREAS, the Common Council of the City of South Bend, <br />Indiana, finds that the Plan would be in the best interests of <br />the City of South Bend and the residents of the City of South <br />Bend and there was not sufficient evidence presented in objection <br />to the recommended project in the facilities plan. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA, THAT: <br />Section I. The South Bend, Indiana Wastewater Treatment <br />Plant Facilities Plan dated May 1998, is hereby approved and <br />adopted by the Common Council of the City of South Bend; and <br />Section II. The Plan shall be submitted to the Indiana <br />Department of Environmental Management for its review and <br />approval. <br />Section III. This Resolution shall be in full force and <br />effect from and after the adoption by the Common Council and <br />approval by the Mayor. <br />ls/ Sean Coleman <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Jack <br />Dillon, director of Environmental Services, made the presentation <br />for the resolution. He reported that this resolution, approving <br />and adopting the twenty year plan for the Wastewater Treatment <br />Plant. He advised that this resolution and the bond ordinance <br />are required by IDEM as part of the application for State <br />Revolving Loan monies. Council Member Broden made a motion to <br />strike Section 4 of the resolution as it a replicate of Section <br />3, seconded by Council Member Hosinski. The motion carried. <br />Council Member Hosinski made a motion to adopt this resolution, <br />as amended, seconded by Council Member Ujdak. The resolution was <br />adopted by a roll call vote of eight ayes. <br />BILLS, FIRST READING <br />BILL NO. 52 -98 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: <br />THE ALLEY TO BE VACATED IS DESCRIBED AS THE FIRST <br />EAST -WEST ALLEY SOUTH OF S. PRAIRIE AVENUE FROM <br />THE WEST RIGHT -OF -WAY LINE OF S. SWYGART AVENUE TO <br />THE EAST RIGHT -OF -WAY LINE OF THE FIRST NORTH- <br />SOUTH ALLEY WEST OF S. SWYGART AVENUE FOR A <br />DISTANCE OF APPROXIMATELY 128 FEET AND A WIDTH OF <br />APPROXIMATELY 13.2 FEET. PART SITUATED IN PERKIN'S <br />SUBDIVISION (UNRECORDED) IN THE CITY OF SOUTH <br />BEND, ST. JOSEPH COUNTY, INDIANA <br />This bill had first reading. Council Member Varner made a motion <br />to refer this bill to the Public Works and Property Vacation <br />Committee, and set it for public hearing and third reading on <br />July 13, seconded by Council Member Kelly. The motion carried. <br />BILL NO. 53 -98 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, APPROPRIATING $17,646.30 FROM SEWER <br />REPAIR INSURANCE FUND (FUND 640) <br />This bill had first reading. Council Member Hosinski made a <br />motion to refer this bill to the Utilities Committee, and set it <br />for public hearing and third reading on July 13, seconded by <br />Council Member Varner.
