REGULAR MEETING NOVEMBER 8, 1999 This being the time heretofore set for the Public Hearing on the above bill, proponents and opponents were given an opportunity to be heard. There being no one present wishing to speak to the Council either in favor of or in opposition to this bill, Councilmember Uj dak made a motion for favorable recommendation to full Council concerning this bill. Councilmember Varner seconded the motion which carried by a voice vote of six (6) ayes. BILL NO. 79 -99 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF MC KINLEY AVENUE AND BLVD. DE LA PAIX IN THE CITY OF SOUTH BEND, IN Councilmember Hosinski made a motion to strike this bill from the agenda. Councilmember Aranowski seconded the motion which carried by a voice vote of six (6) ayes. BILL NO. 81 -99 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 705 LINCOLNWAY EAST IN THE CITY OF SOUTH BEND, INDIANA Councilmember Hosinski reported that the Zoning & Annexation Committee met on this bill and sends it to the Council with a unanimous favorable recommendation. Mr. John Byorni, Assistant Director, Area Plan Commission, Room 1140 County -City Building, South Bend, Indiana, presented the report from the Commission. Mr. Byorni advised that the petitioner is requesting a zone change from "C" Commercial, "E" Height and Area to `B" Residential, `B" Height and Area to allow multi - family apartments. Mr. Byorni noted that the property currently contains a multi - family building. Access to the site is from Lincolnway East. The total site to be rezoned is five thousand six hundred (5,600) square feet of which the buildings occupy twenty -four per cent (24 %) of the site, parking and drives will occupy twenty -four per cent (24 %) and fifty -two per cent (52 %) of the site will remain as open space. Mr. Byorni further noted that based on information available prior to the Area Plan Commission Public Hearing, the Area Plan staff recommended that this petition we sent to the Council with a favorable recommendation. This site has been in continuous use as apartments since before the zoning code was adopted. This rezoning would put the zoning in conformance with the existing use. Further, at it's Public Hearing held on October 19, 1999, the Area Plan Commission sends this petition to the Council with a favorable recommendation. Mr. Patrick D. Myers, owner of property at 705 Lincolnway East, South Bend, Indiana, and Petitioner, made the presentation for this petition. Mr. Myers informed the Council that he has requested this rezoning in order to bring this real estate into compliance with what it has been used for.
