REGULAR MEETING <br />SEPTEMBER 10, 2001 <br />Councilmember Kelly reported that the Residential Neighborhood Committee met on this bill and <br />sends it to the full Council with a favorable recommendation. <br />Ms. Kathy Davis, Director, Department of Code Enforcement, 1300 County -City Building, South <br />Bend, Indiana, made the presentation for this bill. <br />Ms. Davis noted that she has additional language to be placed in this bill which was suggested by <br />Council Attorney Kathleen Cekanski - Farrand. The suggested amendment is as follows: <br />Subsection (c) on the second page entitled "fines" should read as follows: <br />Fines: The fine for violation of this section shall be fifty dollars <br />($50.00) and shall be payable through the Ordinance Violations <br />Bureau pursuant to Section 2 -213 of this Code. <br />The other change is found under Section 20 -119 Penalties. A final line would be added as follows: <br />Fines issued under this Section shall be payable through the Ordinance Violations <br />Bureau pursuant to Section 2 -213 of this Code. <br />Ms. Davis stated that the purpose of this ordinance is to improve the quality of life and to enhance <br />the enforcement of parking requirements in the City particularly in the residential districts. This bill <br />would allow the City to address the parking of vehicles in inappropriate places or for inappropriate <br />purposes through the use of tickets issued by police officers or inspectors with the Department of <br />Code Enforcement. This method would immediately reach the owners of the vehicles and provide <br />a more efficient process for enforcement of the City's zoning and parking laws than the current <br />lengthy process of filing a formal lawsuit to enforce such laws in Circuit or Superior Court. She <br />noted that this ordinance would be a tremendous change for her department in so far as addressing <br />the issues that they face on a daily basis. To be able to address these problems through the ticketing <br />process would speed the enforcement and would make sure that they are addressing the party that <br />is violating the law and would get the neighborhoods back into the kinds of conditions that are <br />acceptable in a very quick manner. <br />Councilmember Kelly made a motion to accept the amendment as proposed. Councilmember <br />Coleman seconded the motion which carried by a voice vote of six (6) ayes. <br />Councilmember Kelly made a motion to send this bill to full Council with a favorable <br />recommendation, as amended.
