He asked if it was possible to amend this language at this time to <br />remove that issue from the ordinance. <br />Council Attorney Cekanski - Farrand noted that there is no motion on the table so any motion is <br />acceptable. <br />Therefore, Councilmember Kelly made a motion to strike that portion of the ordinance which <br />references seizure of tickets. Councilmember King seconded the motion. Council Attorney <br />Cekanski - Farrand noted that to be more specific Section 13 -38 Paragraph (a) would read as follows: <br />Any person who violates any provision of this Article shall be issued a citation. <br />Councilmember Ujdak reiterated that in Section 13 -38 entitled Penalties, Section (a) would read, <br />"Any person who violates any provision of this Article shall be issued a citation." The words being <br />stricken would are "and all tickets offered for sale in violation of this Article may be seized as <br />evidence by a sworn police officer." <br />The motion to amend the bill as outlined above passed by a roll call vote of seven (7) ayes. <br />Additionally, Councilmember Kelly made a motion that this bill be sent to the full Council with a <br />favorable recommendation as substituted and amended. Councilmember King seconded the motion <br />which carried by a voice vote. <br />BILL NO. 62 -01 PUBLIC HEARING ON A BILL OF THE COMMON <br />COUNCIL OF THE CITY OF SOUTH BEND <br />APPROPRIATING $8,640.00 IN DONATED FUNDS <br />FROM HUMAN RIGHTS FEDERAL FUND ( #258) TO <br />PAY EXCESS EXPENSES OF HUMAN RIGHTS <br />AWARENESS AND AWARDS BANQUET <br />Councilmember Aranowski reported that the Personnel & Finance Committee met on this bill and <br />sends it to the Council with a favorable recommendation. <br />Mr. Lonnie Douglas, South Bend Human Rights Commission, 1440 County -City Building, South <br />Bend, Indiana, made the presentation for this bill. <br />Mr. Douglas stated that the Human Rights Commission has raised funds in the sum of eight <br />thousand six hundred forty dollars ($8,640.00) from corporate sponsors to pay the cost of a banquet <br />which they have already held. The funds are presently in an account in the City of South Bend. He <br />noted that one hundred thirty -six (136) people attended the banquet and not sixty -two (62) as he <br />previously stated. It was well planned and organized and a lot of time was spent reaching out to all <br />aspects of the community including grassroots as well as business owners and others in the <br />community. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />There was no one present wishing to speak in favor of this bill. <br />The following individual spoke in opposition: <br />Miss Joyce Boaler,1606 Hillsdale Road, South Bend, Indiana, stated that she obj ects to more money <br />being given out for this project. Events should not be planned that rely on charitable contributions <br />because if they run short local or federal funds must be utilized. She stated that it is unnecessary to <br />do this kind of thing and use monies that come out of taxpayers pockets. <br />
