REGULAR MEETING SEPTEMBER 9, 2002 <br />SECTION II. The Common Council hereby determines that the property owner is qualified for and <br />is granted Real property tax deduction for a period of ten a0J years, and further determines that the <br />petition substantially complies with Chapter 2, Article 6, of the Municipal Code of the City of South <br />Bend and Indiana Code 6- 1.1 -12 et sea. <br />SECTION III. The Common Council pursuant to Section 2 -84 of the South Bend Municipal Code <br />finds the ten (LOJ years is the appropriate and rational time period for this tax abatement in light of <br />the following: <br />1. The petitioner was asked by the City of South Bend to relocate his business to <br />accommodate the TJX Company's new warehouse distribution center. <br />2. The petitioner was most cooperative and fair in his dealings with all involved in the <br />TJX Company project. <br />3. The petitioner also facilitated the site clearing process by relocating equipment on his <br />property prior to the date at which his property was to be transferred. The petitioner <br />did all of this without knowing exactly how or where he would continue operations. <br />SECTION IV. The Council further exercises its authority pursuant to Indiana Code 6-1.1-12.1 - <br />11.3(c) and waives certain compliance requirements with such waiver taking place after public <br />hearing. The Council further finds that each of the additional findings required pursuant to Indiana <br />Code 6 -1.1- 12.1 -4.5 have been met, and that JVH's property at 3152 Mary Court is declared an <br />Economic Revitalization Area. <br />SECTION V. This Resolution shall be in full force and effect from and after its adoption by the <br />Common Council and approved by the Mayor. <br />s/Roland Kelly <br />Member of the Common Council <br />Council President Kelly advised that since there was not a quorum at the Community and Economic <br />Development Committee meeting this afternoon, this bill comes to the Council without a <br />recommendation. <br />Mr. Jim Van Houten, President and Owner of JVH, no address given, made the presentation for this <br />Resolution. <br />Mr. VanHouten advised that JVH does business as MTE Truck and Trailer Service and were <br />awarded a real property tax abatement on June 24, 2002, for property located at 4833 Ameritech <br />Drive. After further review however, the company has now made the decision to locate their facility <br />at 3152 Mary Court in the Young's Industrial Park and they are asking to have their tax abatement <br />transferred to the new site. <br />A Public Hearing was held on the Resolution at this time. <br />There being no one present wishing to speak to the Council either in favor of or in opposition to this <br />Resolution, Councilmember Coleman made a motion to adopt this Resolution.
