REGULAR MEETING JULY 22, 2002 <br />will be brought back to the Council for consideration. Council Attorney Kathleen Cekanski - Farrand <br />advised that the petitioner in this case filed a letter with the City Clerk's Office requesting that this <br />bill be continued indefinitely. It is the policy of the City Council and the City Clerk that when this <br />type of situation occurs, the publication of the legal notice of Public Hearing will be done prior to <br />the actual hearing. By state law this publication is required only once prior to the original Public <br />Hearing. Additionally, this bill will be returned to the Zoning and Annexation Committee which <br />will have a Public Hearing. Attorney Cekanski- Farrand advised that if a representative from the <br />area that would be affected by this proposed annexation and rezoning is present and if they would <br />provide their name and address to the Clerk's office they would receive a telephone call advising <br />them of when this bill will be heard by the Council. However, the legal notice will be published ten <br />(10) days prior to the Public Hearing. It is noted that no one present submitted their name and <br />telephone number for this notification. <br />BILL NO. 40 -02 PUBLIC HEARING ON A BILL TO VACATE THE <br />FOLLOWING DESCRIBED PROPERTY: THE FIRST <br />EAST /WEST ALLEY SOUTH OF MISHAWAKA <br />AVENUE FROM 21 ST STREET WEST TO THE FIRST <br />NORTH /SOUTH ALLEY; AND THE FIRST <br />NORTH /SOUTH ALLEY WEST OF 21ST STREET FROM <br />THE FIRST EAST /WEST ALLEY SOUTH OF <br />MISHAWAKA AVENUE <br />Councilmember King noted that this bill will be postponed until the August 12, 2002 meeting of the <br />Council and will not be coming up tonight for consideration. Councilmember Varner made a motion <br />to continue this bill until the August 12, 2002 meeting of the Council at the request of the petitioner. <br />Councilmember Coleman seconded the motion which carried by a voice vote of nine (9) ayes. <br />BILL NO. 42 -02 PUBLIC HEARING ON A BILL OF THE COMMON <br />COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING CHAPTER 13, BY THE INCLUSION OF <br />NEW ARTICLE 1, ENTITLED GANG LOITERING <br />REGULATIONS AND DELETING SECTIONS 13 -55 AND <br />13 -56 OF THE SOUTH BEND MUNICIPAL CODE <br />Councilmember King advised that further consideration of this bill has been postponed to the August <br />26, 2002 meeting. Therefore, Councilmember Varner made a motion to continue this bill until the <br />August 26, 2002 meeting of the Council at the request of the petitioner.
