REGULAR MEETING <br />JUNE 10, 2002 <br />SECTION III. The Common Council hereby determines and finds that the proposed <br />described redevelopment or rehabilitation can be reasonably expected to yield benefits identified in <br />the Statement of Benefits set forth as Sections I through II of the Petition for Real Property Tax <br />Abatement Consideration and that the Statement of Benefits form prescribed by the State Board of <br />Accounts are sufficient to justify the deduction granted under Indiana Code 6- 1.1- 12.1 -3. <br />SECTION IV. The Common Council hereby accepts the report and recommendation of the <br />Community and Economic Development Committee that the area herein described be designated as <br />an Economic Revitalization Area and hereby adopts a Resolution designating this area as an <br />Economic Revitalization Area for purposes of real property tax abatement. <br />SECTION V. The designation as an Economic Revitalization Area shall be limited to two <br />(2) calendar years from the date of the adoption of this Resolution by the Common Council. <br />SECTION VI. The Common Council pursuant to Section 2 -84 of the South Bend Municipal <br />Code finds the ten 10 years is the appropriate and rational time period for this tax abatement in <br />light of the following: <br />1. The petitioner was asked by the City of South Bend to relocate the business to <br />accommodate the TJX Company's new warehouse distribution center. <br />2. The petitioner will incur additional building costs associated with the new location <br />as a result of the restrictive building covenants of the new area. <br />3. The new location fits the City of South Bend's development plans for the area and <br />will support the warehouse and distribution services already located within the area. <br />The Common Council hereby determines that the property owner is qualified for and is granted <br />property tax deduction for a period of ten 10 years. <br />SECTION VII. The Common Council directs the City Clerk to cause notice of the adoption <br />of this Declaratory Resolution for Real Property Tax Abatement to be published pursuant to Indiana <br />Code 5 -3 -1 and Indiana Code 6- 1.1- 12.1 -2.5, said publication providing notice of the public hearing <br />before the Common Council on the proposed confirming of said declaration. <br />SECTION VIII. This Resolution shall be in full force and effect from and after its adoption <br />by the Common Council and approval by the Mayor. <br />s /Roland Kelly <br />Member of the Common Council <br />Councilmember King reported that the Community and Economic Development Committee <br />conducted a Public Hearing on this bill this afternoon and voted to send it to the full Council with <br />a favorable recommendation. <br />Mr. Jim Van Houten, Owner and President of JVH, Inc., no address given, made the presentation <br />for this Resolution. <br />Mr. VanHouten advised that JVH proposes to build a twenty seven thousand two hundred (27,200) <br />square foot building on approximately 7.7 acres in the US 31 Industrial Park. After completion, the <br />building will be leased to MTE Truck & Trailer Service. This company is a Mack service dealer for <br />Mack Truck and is an associate dealer for Volve Trucks. They will be selling, servicing, repairing <br />and selling parts for both Volvo and Mack. Mr. VanHouten noted that MTE Parts, Inc. is a Great <br />Dane parts distributor. This is a company that presently is at 1313 Prairie Avenue and will be <br />housed at the same location when the building is completed.
