REGULAR MEETING APRIL 22, 2002 <br />RESOLUTION NO. 3092 -02 A RESOLUTION OF THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE <br />MAYOR TO SUBMIT TO THE UNTIED STATES <br />GOVERNMENT, DEPARTMENT OF HOUSING AND <br />URBAN DEVELOPMENT, AN APPLICATION FOR <br />SECTION 108 LOAN FUNDS <br />WHEREAS, the Mayor of the City of South Bend, Indiana, is the Chief Executive Officer <br />of the City and is the applicant for Section 108 funds available through the U.S. Department of <br />Housing and Urban Development (HUD). <br />NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South <br />bend, Indiana, as follows: <br />SECTION I. That the Mayor of the City of South Bend, Indiana, is hereby authorized to <br />submit to HUD, the 2001 Section 108 Loan application in the maximum amount of $3,405,000 <br />under Title I of the Housing and Community Development Act of 1974, as amended; and to take all <br />other necessary actions to secure these funds. <br />SECTION II. That for every activity, project, or program to be funded under this Resolution, <br />the Mayor shall submit to the Common Council an appropriation ordinance prior to expenditure of <br />any Section 108 loan funds received upon approval of this application. <br />SECTION III. That this Resolution shall be in full force and effect from and after its <br />adoption by the Common Council and approval by the Mayor. <br />s /Karen White <br />Member of the Common Council <br />Councilmember King reported that the Community and Economic Development Committee <br />conducted a Public Hearing this afternoon on this bill and voted unanimously to send this bill to the <br />full Council with a favorable recommendation. <br />Ms. Beth Leonard, Department of Community and Economic Development, 12th Floor, County - <br />City Building, South Bend, Indiana, made the presentation for this Resolution. <br />Ms. Leonard advised that this Resolution will allow the Mayor to enter into documents to secure <br />the Section 108 loan that was part of the October 2000 Public Hearing process of which the Council <br />appropriated funds last year. Ms. Leonard apologized and noted that due to an oversight on her part <br />this Resolution was not submitted earlier. <br />A Public Hearing was held on the Resolution at this time. <br />There being no one present wishing to speak to the Council either in favor of or in opposition to this <br />Resolution, Councilmember Coleman made a motion to adopt this Resolution.
