REGULAR MEETING MAY 10, 2004 Mr. Jeff Myers, Staff Planner, Area Plan Commission, 1805 Hickory Road, South Bend, Indiana, presented the report from the Commission. Mr. Myers advised that the Petitioner is requesting a zone change from "A" Residential, "A" Height and Area and `B" Residential, "B" Height and Area to `B" Residential, "B" Height and Area to allow a senior living campus. The current existing land use is vacant. Located to the north is an office zone "PHC" Professional Health Care and a retirement center zone `B" Residential, `B" Height and Area. To the south is a single family home zoned "A" Residential, "A" Height and Area and vacant land zoned `B" Residential, `B" Height and Area. To the east is an apartment complex zoned `B" Residential, `B" Height and Area. To the west are single family homes zoned "A" Residential, "A" Height and Area. Access to the site is from Ironwood Drive. Water and sewer are available to the site. The drainage has been addressed by the petitioner. The total site to be rezoned is 19.6 acres. Of that, the buildings will occupy 1.42 acres, or 7.4 percent of the site. Parking and drives will occupy 3 acres, or 15.6 percent of the site. Open space will occupy 15.2 acres, or 77 percent of the site. A check of the Agency's maps indicates that no public wells, wetlands, flood or environmental hazard area are present. The site plan is preliminary. The City Engineer made the following comments: they had concerns about drainage and the number of access points onto Ironwood Dr. The petitioner has contacted their office and made changes to the site plan to address these concerns. In 1997, the site received a favorable recommendation from the APC and was approved by the council for a rezoning to `B" Residential for a senior campus and independent /assisted living. That rezoning has expired. Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation, subject to a final site plan. This site is bordered on three sides by multi - family zoning, and a similar use (St. Paul's Retirement Community) is across Inwood Road. In the staff's opinion, this is an appropriate located for this zoning and use in the City. Mr. Robert Gummer, NCSRB, AIA, President, PDC Midwest, Inc., 700 Walnut Ridge Drive, Hartland, Wisconsin, made the presentation for this bill on behalf of the property owner, Extendicare Health Services, Inc. 4940 Blazer Parkway, Dublin, Ohio. Mr. Gummer advised that the property to be rezoned is located at the Southeast intersection of Ironwood Road and Inwood Road. The petitioner is requesting that the property be rezoned from "A" Residential and `B" Residential; "A" Height and Area to "B" Residential; `B" Height and Area. Mr. Gummer stated that the proposed use of the property is for a Senior Living Campus. The initial phase of development shall be for an assisted living facility. This being the time heretofore set for the Public Hearing on the above bill, proponents and opponents were given an opportunity to be heard. There being no one present wishing to speak to the Council either in favor of or in opposition to this bill, Councilmember Varner made a motion for favorable recommendation to full Council concerning this bill. Councilmember Puzzello seconded the motion which carried by a voice vote of nine (9) ayes. BILL NO. 18 -04 PUBLIC HEARING ON A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED APPROXIMATELY 195' NORTHEAST OF THE INTERSECTION OF PRAIRIE AVENUE AND LOCUST ROADS ON THE SOUTHERLY SIDE OF PRAIRIE AVENUE IN THE CITY OF SOUTH BEND, INDIANA Councilmember Kelly made a motion to hear the substitute version of this bill. Councilmember Varner seconded the motion which carried by a voice vote of nine (9) ayes. 1
