REGULAR MEETING <br />APRIL 26, 2004 <br />Council President White, Chairperson, Council Rules Committee, reported that this Committee <br />held a Public Hearing on this bill this afternoon and voted to send it to the full Council with a <br />favorable recommendation. <br />Council President White, 1912 Malvern Way, South Bend, Indiana, made the presentation for <br />this bill. <br />Council President White advised that this bill would allow certain amendments to its governing <br />rules and regulations to help improve the many services provided by the Council to the citizens <br />of South Bend. Council President White noted that the substitute version of this bill would add a <br />new paragraph (o) to Section 2 -8 of the South Bend Municipal code addressing decorum and <br />debate regulations which read as follows: "Persons in the Council Chambers shall turn their cell <br />phones and pages to their silent mode when the Common Council is in session ". She also noted <br />that new sub - paragraphs would be added under the "New Business" portion addressed in Sec. 2- <br />12 of the South Bend Municipal code. These proposed paragraphs would call for Council <br />Members who sit on other boards and commissions like the Area Plan Commission, MACOG, <br />etc. to give verbal updates on any meetings which they have attended in the last two (2) weeks; <br />as well as announcements of upcoming events. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this bill, Councilmember Varner made a motion for favorable recommendation to full Council <br />concerning this bill as substituted. Councilmember Kuspa seconded the motion which carried by <br />a voice vote of nine (9) ayes. <br />BILL NO. 27 -04 PUBLIC HEARING ON A BILL OF THE COMMON <br />COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING VARIOUS SECTIONS OF CHAPTER 20, <br />ARTICLE 3, OF THE SOUTH BEND MUNICIPAL <br />CODE ADDRESSING ABANDONED VEHICLES <br />Council President White made a motion to hear the substitute version of this bill. <br />Councilmember Kelly seconded the motion which carried by a voice vote of nine (9) ayes. <br />Councilmember Ann Puzzello, Chairperson, Health and Public Safety Committee reported that <br />this committee met on this bill this afternoon and voted to send it to the full Council with a <br />favorable recommendation. <br />Councilmember Ann Puzzello, 4th District Council, 1247 E. LaSalle, South Bend, Indiana, made <br />the presentation for this bill. <br />Councilmember Puzzello advised that this bill would amend two (2) sections of Chapter 20, <br />Article 3 of the South Bend Municipal Code which addresses "Abandoned Vehicles ". The first <br />amendment would amend the definition for "abandoned vehicle" so that it is consistent with <br />Indiana state law, as well as identify any vehicle which does not have a state vehicle license plate <br />as an abandoned vehicle. She indicated that other communities include vehicles without state <br />license plates in their definitions of abandoned vehicles. The second amendments to the bill is to <br />§20 -29 which addresses fees which may be collected to recover administrative costs related to <br />abandoned vehicle regulations. Councilmember Puzzello stated that upon the recommendation <br />of the Council Attorney and the City of South Bend Legal Department that the words "and lien <br />holder" be deleted from §20 -29. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />0 <br />1 <br />1 <br />
