REGULAR MEETING DECEMBER 13,2004 BILL NO. 47-04 PUBLIC HEARING ON A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED IN THE 2600 BLOCK OF PRAIRIE AVE., COUNCILMANIC DISTRICT NO. 6, IN THE CITY OF SOUTH BEND, INDIANA Councilmember Pfeifer made a motion to consider the second substitute version of this bill. Councilmember Puzzello seconded the motion which carried by a voice vote of nine (9) ayes. Additionally, Councilmember Pfeifer made a motion to continue this bill until the January 10, 2004 meeting of the Council. Councilmember White seconded the motion which carried by a voice vote of nine (9) ayes. BILL NO. 84-04 PUBLIC HEARING ON A BILL TO EXTEND DEADLINE FOR WATER LEAK INSURANCE FUND (#644)REPAYMENT OF LOAN RECEIVED FROM WATER WORKS GENERAL FUND Councilmember Kirsits, Chairperson, Utilities Committee, reported that this committee held a Public Hearing on this bill this afternoon and sends it to the full Council with a favorable recommendation. Mr. John Stancati, Director, Water Works, 209 N. Main Street, South Bend, Indiana, made the presentation for this bill. Mr. Stancati advised that due to the inability of the Leak Insurance Fund to pay back the $260,000 to the Water Works General Fund by December 31, 2004, he is requesting to extend the pay back until December 31, 2005. Due to the age and deterioration of the City's water pipe system, the City experienced an unexpected need for repair and replacement of City water lines in recent years. This unexpected cost exceeded funds set aside and dedicated to such repair were held in Water Leak Insurance (#644.) The water user fee of$1.50 per month per user is the sole source of revenue for Fund#644 and was inadequate to cover the actual cost of water line repair/replacement in 2002-2003. The Water Leak Insurance Fund(#644) is capable of covering the costs of water pipe repair/replacement for 2004, but has no year-end surplus and thus will need to extend the pay back. This being the time heretofore set for the Public Hearing on the above bill, proponents and opponents were given an opportunity to be heard. There being no one present wishing to speak to the Council either in favor of or in opposition to this bill, Councilmember Varner made a motion for favorable recommendation to full Council concerning this bill. Councilmember Kelly seconded the motion which carried by a voice vote of nine (9) ayes. BILL NO. 85-04 PUBLIC HEARING ON A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING$40,100 OF INDIANA DEVELOPMENT FINANCE AUTHORITY GRANT FUNDS WITHIN FUND 210 FOR THE PURPOSE OF ENVIRONMENTAL INVESTIGATION OF PROPERTY LOCATED AT 700 SOUTH FRANKLIN STREET IN SOUTH BEND, INDIANA Councilmember Varner made a motion to hear the substitute version of this bill. Councilmember Kuspa seconded the motion which carried by a voice vote of nine (9) ayes. Additionally, Councilmember Pfeifer made a motion to continue this bill until the 9 — ---
