REGULAR MEETING AUGUST 23,2004 <br /> ohn Voorde, City Clerk Sean Coleman, Chairperson <br /> Committee of the Whole <br /> REGULAR MEETING RECONVENED <br /> Be it remembered that the Common Council of the City of South Bend reconvened in the <br /> Council Chambers on the fourth floor of the County-City Building at 7:11 p.m. Vice- <br /> President Roland Kelly presided with seven (7) members present. <br /> BILLS -THIRD READING <br /> ORDINANCE NO. 9524-04 AN ORDINANCE OF THE <br /> COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, AUTHORIZING <br /> THE CITY OF SOUTH BEND, INDIANA, <br /> TO ISSUE ITS "TAXABLE ECONOMIC <br /> DEVELOPMENT REVENUE BONDS, <br /> SERIES 2004 (ERSKINE COMMONS <br /> PROJECT)" AND APPROVING AND <br /> AUTHORIZING OTHER ACTIONS IN <br /> RESPECT THERETO <br /> This bill had third reading. Councilmember Coleman made a motion to consider the <br /> substitute version of this bill. Councilmember Varner seconded the motion which carried <br /> by a voice vote of seven (7) ayes. Additionally, Councilmember Coleman made a motion <br /> to pass this bill as substituted. Councilmember Varner seconded the motion which <br /> carried. The bill passed by a roll call vote of seven (7) ayes. <br /> RESOLUTIONS <br /> RESOLUTION NO. 3367-04 A RESOLUTION CONFIRMING THE <br /> ADOPTION OF A DECLARATORY <br /> RESOLUTION DESIGNATING CERTAIN <br /> AREAS WITHIN THE CITY OF SOUTH BEND, <br /> INDIANA, COMMONLY KNOWN AS 211-213 <br /> WEST WASHINGTON STREET AS AN <br /> ECONOMIC REVITALIZATION AREA FOR <br /> PURPOSES OF A SIX (6) YEAR REAL <br /> PROPERTY TAX ABATEMENT FOR <br /> DILLINGHAM HILL RE, LLC. <br /> WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a <br /> Declaratory Resolution designating certain areas within the City as Economic <br /> Revitalization Areas for the purpose of tax abatement consideration; and <br /> WHEREAS, a Declaratory Resolution designated the area commonly known as 211-213 <br /> West Washington Street, South Bend, Indiana, and which is more particularly <br /> described as follows: <br /> The land and all improvements now or hereafter located thereon, located at the <br /> intersection of Washington Street and Main Street in the City of South Bend, County of <br /> St. Joseph, State of Indiana, being more particularly described as follows: <br /> PARCEL I: Lots Numbered Two Hundred Thirty-Nine (239) and Two Hundred Forty <br /> (240) as shown on the Original Plat of the Town, now City of South Bend, Indiana; Also, <br /> a parcel of land to the West of and adjacent to Lots 239 and 240 as shown on the Original <br /> Plat of the Town, now City of South Bend, Indiana, more particularly described as <br /> beginning at the Southwest corner of said Lot 240; thence North along the West line of <br /> said Lots to the Northwest corner of said Lot 239; thence West 14 feet; thence South to a <br /> 4 <br />
