REGULAR MEETING NOVEMBER 26, 2012 <br /> <br /> <br /> <br /> <br /> ALARM SYSTEM <br /> <br /> <br /> WHEREAS, it is in the best interests and necessary to preserve and protect the health, <br />safety and welfare of the public; and <br /> <br /> WHEREAS, it is further recognized and acknowledged that in certain situations such as <br />emergencies, natural disasters and man-made catastrophes, that the use of personnel and equipment <br />of the South Bend Fire Department may be needed in order to perform functions outside the <br />territorial limits of the City of South Bend and is necessary to preserve and protect the health, <br />safety and welfare of the public; and <br /> <br /> WHEREAS, it is further acknowledged that coordination of mutual aid through the Mutual <br />Aid Box Alarm System is desirable for the effective and efficient provision of mutual aid; and <br /> <br />WHEREAS, Indiana Code §§ 36-1-7-1 et seq., as amended from time-to-time (“Interlocal <br />Cooperation Act”), authorizes one or more governmental entities to exercise jointly or by one <br />entity on behalf of the other powers that may be exercised by such units severally; and <br /> <br />WHEREAS, the Executives of the City of South Bend and other neighboring jurisdictions <br />including jurisdictions in the nearby state of Illinois have reached an agreement and have <br />approved the Interlocal Agreement - Mutual Aid Box Alarm System which is attached hereto and <br />Exhibit “A” <br />incorporated herein as . <br /> <br />NOW, THEREFORE, AND PURSUANT TO THE AUTHORITY GRANTED BY THE CITY <br />OF SOUTH BEND, INDIANA, UNDER INDIANA CODE § 36-1-7, BE IT HEREBY <br />RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND AS <br />FOLLOWS: <br /> <br />Section 1. The Common Council of the City of South Bend, Indiana, has considered and <br />hereby ratifies, confirms and approves the Interlocal Agreement - Mutual Aid Box Alarm System <br />Exhibit “A” <br />attached to this Resolution as . <br /> <br />Section 2. This Resolution shall be in full force and effect from and after its adoption by the <br />Common Council and approval by the Mayor. <br /> <br /> s/Derek Dieter <br /> Member of the Common Council <br /> <br />Councilmember Oliver Davis made a motion to amend this bill. Councilmember White <br />seconded the motion which carried by a voice vote of nine (9) ayes. <br /> <br />Councilmember Dr. Fred Ferlic, Chairperson, Health & Public Safety Committee, reported that <br />this committee held a Public Hearing on this bill this afternoon and voted to send it to the full <br />Council with a favorable recommendation. <br /> <br />Stephen Cox, Fire Chief, South Bend Fire Department, 1222 S. Michigan Street, South Bend, <br />Indiana, made the presentation for this bill. <br /> <br />Chief Cox advised that this bill approves the Interlocal Agreement – Mutual Aid Box Alarm <br />System which provides for joint cooperation with neighboring jurisdictions in certain emergency <br />situations in order to share personnel and equipment necessary to preserve and protect the health, <br />safety and welfare of the public. He asked the Council for their favorable consideration. <br /> <br />A Public Hearing was held on the Resolution at this time. <br /> <br /> <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this Resolution, Councilmember Schey made a motion to adopt this Resolution as amended. <br />14 <br /> <br /> <br />
