Rockensuess <br />Commissioner <br />Re: Comfort Letter <br />Political Subdivision <br />OmniPlex Warehouse <br />1408 Elwood Avenue <br />South Bend, St. Joseph County <br />Brownfield #4000022 <br />In response to the request by Heartland Environmental Associates, Inc. <br />(Heartland) on behalf of the Civil City of South Bend (Owner) to the Indiana Brownfields <br />Program (Program) for assistance concerning the property located at 1408 Elwood <br />Avenue, South Bend, Indiana (Site), the Indiana Department of Environmental <br />Management (IDEM) has agreed to provide this Comfort Letter to outline applicable <br />limitations on liability for environmental conditions on the Site. This letter does not <br />provide a release from liability. It will, however, establish whether environmental <br />conditions on the Site might be a barrier to redevelopment or transfer. <br />Site Description and History <br />The 14.028-acre Site is one parcel identified by the State by parcel #71-08-02- <br />101-006.000-026. The Site is currently improved with six buildings, including one large <br />industrial building located along the eastern boundary of the Site, one industrial building <br />situated on the southeastern portion of the Site, two buildings in the central portion and <br />two smaller maintenance buildings in the northwestern portion of the Site. Historical <br />documentation indicates that as many as 17 buildings were developed as part of the <br />brewery operations conducted on the Site. <br />The Site was developed for usage as a brewery circa 1880 and operated as a <br />commercial brewery until circa 1972. The Site was also utilized as storage, a soft drink <br />company and meat packing facility from the mid-1920s through the early 1930s when <br />prohibition -era laws prohibited alcohol production.
