4. Securiy De osit: Operator shall make a security deposit payment of $1,000.00 due upon receiving of license from city of South Bend Indiana, which shall be returned to Smart Park when either party cancels or makes changes WIHTIN 15 days after SMART PARKING INC vacates property. Landlord's obligation to return the security deposit to Smart Park is conditioned on receipt by Landlord of all rent due under this agreement. 5. Additional Rules and Regulations. Tenant use of the Parking Lot shall be subject to the city/state Rules and Regulations and must stay in compliance at all times. ALL SIGNS NEEDS TO BE APPROVED BY LANDLORD, prior to OPERATOR displaying signs on premise. SIGNS must mention COLFAX PLACE visitors or tenants 6. UsetTiming of parking lot. During the agreement, tenant may use the Parking Spaces solely for parking of automobiles for revenue collection. 7. Responsibilities and Duties of TENANT Smart Parking Inc (Operator) shall be responsible for all operating costs such as: (a) Supply equipment(s) necessary for the operation of the Parking Lot in a professional manner, all its business operating costs (b) Pay annual license fee to city of South Bend for parking lot license (c) Operate the Parking Lot in compliance with all applicable statutes, laws, ordinances, rules and regulations of any governmental authority having jurisdiction over the Parking Lot, and pay annual parking lot license fee to city of South Bend. (d) 13AYS & TIMES for PAY PARKING allowed: AFTER BUSINESS HOURS of COLFAX PLACE: ALLOWED 'TIMINGS: only during MONDAY TO F'RIDAY after 6pm and ALL DAY SATURDAY & SUNDAY 8. Alterations. Tenant shall not make any alterations, additions or improvements to the Parking Lot without Lessor's prior written consent. All such changes made by either of the parties hereto upon the Parking Lot shall be the property of Landlord and shall remain upon the property and be surrendered by Tenant upon the Expiration Date. 9. Assignment and Subletting. Lessee (Tenant) shall not assign this Agreement nor sublicense all or any part of the Parking Lot without the prior written consent of Lessor/Landlord. 10. Insurance. (Tenant) shall acquire and maintain public liability insurance, insuring Tenant and Landlord Two Million Dollars ($2,000,000) and add landlord as additional insured.
