REGULAR MEETING JANUARY 28, 2013 <br /> <br /> <br /> <br /> <br />Councilmember Dr. Fred Ferlic, Chairperson, Zoning & Annexation Committee, reported that <br />this committee held a Public Hearing on this bill this afternoon and voted to send it to the full <br />Council with a favorable recommendation. <br /> <br />Mr. Mark Lyons, Administrative Zoning Administrator, St. Joseph County Building Department, <br />125 S. Lafayette Blvd., South Bend, Indiana, presented the report from the Area Board of Zoning <br />Appeals. <br /> <br />Mr. Lyons advised that the petitioner is seeking a special exception to allow a tattoo, body <br />piercing establishment in a CBD” District, on property located at 127 W. Washington Street. <br />Mr. Lyons noted that the Area Board of Zoning Appeals held a public hearing on December 5, <br />2012, and sends it to the Common Council with a favorable recommendation. <br /> <br />Mr. David Martin, 127 W. Washington Street, South Bend, Indiana, made the presentation for <br />this bill. <br /> <br />Mr. Martin advised that he is seeking a special exception to allow a tattoo, body piercing <br />establishment to be operated in the Central Business District. He stated that he is the owner of <br />Bicycle Gallery and that what he would like to do is expand the scope of his business to include <br />tattooing and piercing. He stated that his goals are to expand and build on the art scene in South <br />Bend. He stated that he would like to be on the cutting edge for art in downtown South Bend. <br />Mr. Martin advised that he has been tattooing since 1996 and has been tattooing in this area and <br />that he is one of the foremost tattoo artist in Indiana and draw clientele nationally. He stated that <br />he has been licensed in the county and has always been in good standing. Mr. Martin advised <br />that the tattooing and body piercing portion of the business would not be visible from the street <br />or gallery, and that no one under the age of 18 would be considered for a tattoo. He asked the <br />Council for their favorable consideration. <br /> <br />A Public Hearing was held on the Resolution at this time. <br /> <br />There were thirteen individuals who spoke in favor of this bill. There was no one present <br />wishing to speak in opposition to this bill. Councilmember Oliver Davis made a motion to adopt <br />this Resolution. Councilmember White seconded the motion which carried by a voice vote of <br />nine (9) ayes. <br /> <br /> <br />BILL NO. 13-08 A RESOLUTION OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, <br /> APPROVING A PETITION OF THE AREA <br /> BOARD OF ZONING APPEALS FOR THE <br /> PROPERTY LOCATED AT 1107 MISHAWAKA <br /> AVE.,SOUTH BEND, INDIANA <br /> <br />Councilmember Dr. Fred Ferlic, Chairperson, Zoning & Annexation Committee, reported that <br />this committee met this afternoon and it was the consensus of the Committee to send this bill to <br />the full Council with no recommendation. <br /> <br />There was no presenter in attendance. <br /> <br />Councilmember Oliver Davis made a motion to defeat this bill. Councilmember Karen White <br />seconded the motion which carried.
