Commftt** Ztport: <br /> Zoning and Annexation Committee <br /> go the Common touuttfl of the City of South WO: <br /> The June 9, 1997 meeting of the Zoning and Annexation Committee was called to order by <br /> its Chairperson, Council Member Hosinski, at 4:35 p.m. in the Council informal meeting <br /> room. <br /> Persons in attendance included Council Members: Roland Kelly;James Voll,John Byorni, <br /> Don Fozo,Bernie Feeney, Ann Carol-Simons,Terry Bland,Kathleen Cekanski-Farrand. <br /> Dr.Varner noted that the first item on the agenda was to review Bill No. 91-96 which is a <br /> substitute Bill to re-zone the property located at 1208 Lincolnway East. Mr. John Byorni <br /> showed a site n of the proposed re-zoning. He noted that it received a favorable <br /> P p P <br /> recommendation from both the Area Plan Staff as well as the Area Plan Commission. <br /> Following discussion, Council Member Pfeifer made a motion seconded by Council <br /> Member Broden, that substitute Bill No. 91-96 be recommended favorably to Council. <br /> The motion passed. <br /> The Committee then reviewed Bill No. 31-97 which is a substitute Bill to re-zone the <br /> property located at the corner of Prarie and Locust. Mr. Byorni noted that it received a <br /> favorable recommendation from both the Area Plan Staff as well as the Area Plan <br /> Commission. He showed a proposed site plan of the proposed re-zoning. Mr. Bernie <br /> Feeney made a further presentation. He noted that this is the third re-zoning for the <br /> property in question. He noted that each of the previous re-zonings received a favorable <br /> recommendation from the Commission and each were passed favorably by the Council. <br /> Both prior re-zonings expired in light of the failure to file a final site plan. He assured that <br /> Council that a final site plan would be,timely, filed. <br /> Following discussion, Council Member Pfeifer made a motion seconded by Council <br /> Member Varner that Bill No. 31-97 be recommended favorably to Council. The motion <br /> passed. <br /> The Committee then reviewed Bill NO. 32-97 which is an amendment to the South Bend <br /> Municipal Code. Mr. John Byorni made the presentation. He noted that this is an area <br /> plan initiated re-zoning. He noted that by the passage of this ordinance it would allow <br /> restaurants such as Applebee's and Friday's to be located within the city limits of South <br /> Bend. He also noted that it does various housekeeping measures with regard to <br /> definitions. He noted that in restaurants which are of national chains, for the most part, <br /> which have less than 25% of the restaurant restricted where minors can not be present,that <br /> it would allow them to locate within the city limits with a special exception process taking <br /> place. He also noted that the proposed ordinance would address the Historic Preservation <br /> Commission requiring only district proposals to go before the Area Plan Commission and <br /> not landmarks. The Bill would also remove overlay sign district regulations. <br /> Mr. Don Fozo,the building commissioner, spoke in favor of the proposed ordinance. He <br /> noted that too many national restaurant chains are prohibited from locating within the city <br /> limits under the current zoning regulations. <br />
