Bettie Williams
made the presentation on behalf of Greater New Vision Missionary Baptist Church. She
noted that the purpose of the vacation is to allow a parking lot to be constructed so that the
recreational area for the children can be enclosed.
Following discussion, Council Member Kelly made a motion, seconded by Council
Member Zakrzewski that Bill No. 52-95 be recommended favorably to Council. It was
noted that this vacation request received a favorable recommendation from the Board of
• Public Works(copy attached).
The Committee then reviewed Bill No. 45-95 which is a request to vacate certain
property in Baker's first edition. It was noted that this Bill was continued from the last
Common Council meeting. Ann Kolata made the presentation. She noted that Mr. Magaldi
objected at the last Common Council meeting in light of the ongoing condemnation
proceedings. Ms. Kolata presented a letter which she addressed to Ann Puzzello (copy
attached)noting that appeal process for Mr. Magaldi has passed and that she recommends
that the City Council goes forward this evening. She did note that there is ongoing
discussion with regard to a "trade arrangement" which is separate and distinct from the
vacation procedure.
Council Member Luecke noted that this type of situation where a condemnation is
simultaneously is going on along with a vacation has taken place in the past with his
involvement with the South Bend Heritage.
In light of the fact that the Committee made a formal favorable recommendation at
the last Committee meeting,no formal action was taken today.
There were no presenters for Bill Nos. 54-95 or 55-95.
