Zoninap andtVacation Committee Page 2 <br /> The Committee then reviewed Bill No. 30-89 which would <br /> vacate the first East-West Alley South of Mishawaka Avenue. <br /> Bruce Metzger, the Petitioner, then gave the presentation. <br /> He provided a diagram and photographs of the area in <br /> question as well as several handouts (copies attached) . <br /> The overall purpose of the proposed vacation is to eliminate <br /> traffic with regard to children, dust, standing water, and <br /> mud. He noted that on April 15, 1989 between the hours of <br /> 7:30 a.m. to 9:30 p.m. there were 54 utilizing the area in <br /> question. <br /> Mr. Joseph Jenowski of 921 South Ironwood spoke in <br /> opposition to the proposed vacation. He also showed a map <br /> to the Council Members. He noted that the Fire Department <br /> advised him that a minimum turning radius of 20 feet was <br /> required. He noted that there have been several accidents <br /> onto Ironwood and that if the vacation took place that oil <br /> trucks, trash trucks, etc would have to back onto Ironwood. <br /> Mrs. Helen Janowski of the same address stated that she has <br /> been a resident of the area for 17 years and also spoke <br /> against the proposed vacation. <br /> Council Member Luecke questioned whether the Petitioner had <br /> an agreement to share the alley with the neighbor which <br /> would be concreted and was advised that it would be. <br /> Council Member Niezgodski voiced concern over the amount of <br /> trucks and the problems of ingress and egress. <br /> The Council Attorney then read the letter from Bert Prawat <br /> of the Fire Department which recommended against the <br /> vacation (copy attached) and it was also noted that the <br /> Board of Public Works recommended unfavorably at their <br /> meeting of April 17, 1989 on this proposed vacation. <br /> Council Member Puzzello had several questions with regard to <br /> the turning radius. She then called John Leszczynski, the <br /> City Engineer, to the meeting. He noted that the Board of <br /> Public Works recommended against the vacation and <br /> specifically noted that garbage trucks and graders could not <br /> make the turn. <br /> Following further discussion Council Member Luecke made a <br /> motion seconded by Council Member Puzzello to recommend Bill <br /> No. 30-89 unfavorably. The motion was defeated by a vote of <br /> 3 to 2 . Council Member Slavinskas made a motion seconded by <br />
