7 <br />have a reasonable time in which to complete his loading or unloading and move <br />his truck. <br />Sec. 20-109. – Regulations <br />a) The Board of Public Works may designate, from time to time, by proper resolution, <br />specific streets or blocks thereof, where trucks are expressly prohibited due to safety <br />reasons or engineering standards. The City shall post signs prohibiting trucks in such <br />designated locations. Any truck driving in such prohibited areas shall be in violation of <br />this Section and shall be issued a citation. <br />b) The Board of Public Works has the authority to approve truck routes via permit that <br />deviate from the official truck routes established for the cases listed in Section 20- <br />108.1(a). Permits for such cases are managed and issued by the City Engineer’s office. <br />c) Special Authority <br />(1) The City Engineer for public safety and traffic control shall have the authority to <br />designate the routes to be followed by trucks or truck-trailer combinations, by <br />private, common and contract carriers or by any other person transporting <br />hazardous material, as defined in Section 20-106, in the regular course of business <br />and traveling through and making deliveries within the City. Such official of the <br />City shall adopt a route map for transporting such hazardous materials, indicating <br />such designated routes and designated portions of the City and it shall be unlawful <br />for any of the above-described vehicles, carriers or persons to deviate from such <br />routes. <br />(2) The City Engineer’s office is authorized to issue permits for the use within the <br />City of oversize, overweight, and hazardous vehicles, as defined in Section 20- <br />106. <br />d) Trucks that carry hazardous, oversize and/or overweight loads must have a permit in <br />order to travel anywhere in the City. Such vehicles shall not travel on those streets listed <br />in South Bend Truck Route A-1 without a permit. <br />Sec. 20-109.1 – Exceptions. <br />The provisions of this aArticle do not apply to vehicles: <br />(1) Licensed to operate upon trucks; <br />(2) Licensed to carry passengers for hire; <br />(3) Municipal government vehicles operating on official business; or <br />(4) Public utility vehicles operating on official business. <br />Sec. 20-109.2 – Permits and Liability <br />(a) Permits <br />(1) Permits are managed by the City Engineer’s office. A permit application can be <br />obtained on the City’s website or by calling or visiting the City Engineer’s office, <br />and must be submitted to the City Engineer’s office. <br />(2) A permit fee of $35 dollars will be assessed for a single use permit for oversize, and <br />overweight vehicles and hazardous loads.
