REGULAR MEETING OCTOBER 22, 2012 <br /> <br /> <br /> <br /> <br /> <br />Mr. Lyons advised that the petitioner is seeking a Special Exception to allow an off-site parking <br />lot in a “U” University District. He advised that the Area Board of Zoning Appeals held a public <br />hearing on September 5, 2012 and sends it to the Common Council with a favorable <br />recommendation. <br /> <br />th <br />Richard Deahl, Attorney, Barnes & Thornburg, LLP, 100 N. Michigan Street, 6 Floor, South <br />Bend, Indiana, made the presentation for this bill on behalf of the University of Notre Dame du <br />lac and the Brothers of Holy Cross, Inc.. <br /> <br />Mr. Deahl advised that they are seeking the approval of a “special exception” to allow the <br />existing off-street parking area located West of the existing Saint Joseph High school building to <br />continue to serve the building and adjacent athletic fields in the event any portion of such <br />property is rezoned from “R Single Family to “U” University zoning district. <br /> <br />A Public Hearing was held on the Resolution at this time. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this Resolution, Councilmember Varner made a motion to adopt this Resolution. <br />Councilmember Oliver Davis seconded the motion which carried and the Resolution was <br />adopted by a roll call vote of nine (9) ayes. <br /> <br /> <br />RESOLUTION NO. 4212-12 A RESOLUTION OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND <br /> DESIGNATING CERTAIN AREAS WITHIN THE <br /> CITY OF SOUTH BEND, INDIANA, <br /> COMMONLY KNOWN AS 1038 NOTRE DAME <br /> AVENUE AS RESIDENTIALLY DISTRESSED <br /> AREAS FOR PURPOSES OF A (5) FIVE-YEAR <br /> RESIDENTIAL REAL PROPERTY TAX <br /> ABATEMENT FOR DAVID W. & MARY B. <br /> MURPHY <br /> <br /> <br />WHEREAS, a Statement of Benefits and a petition for residential real property tax <br />abatement have been submitted to and filed with the City Clerk for consideration by the <br />Common Council of the City of South Bend, Indiana, requesting that the area commonly known <br />as 1038 Notre Dame Avenue, South Bend, Indiana, and which is more particularly described as <br />follows: <br /> <br />That part of the Northwest Quarter Section 1, Township 37 North, Range 3 East, Portage <br />Township, City of South Bend, St. Joseph County, Indiana, which is described as Lot “A” as <br />th <br />shown on the plat of “Boyd-Snee’s Subdivision, First Replat” recorded June 13, 2012 in the <br />office of the St. Joseph County, Indiana Recorder as Instrument No. 1217686. <br /> <br /> <br />, <br />and this property has Tax Key Number 18-5105-3702.02be designated as a Residentially <br />Distressed Area under the provisions of Indiana Code 6-1.1-12.1 et seq., and South Bend <br />Municipal Code Sections 2-76 et seq., and; <br /> <br />WHEREAS, the Department of Community and Economic Development has concluded <br />an investigation and prepared a report with information sufficient for the Common Council to <br />determine that the area qualifies as a Residentially Distressed Area under Indiana Code 6-1.1- <br />12.1, et seq., and South Bend Municipal Code Sections 2-76, et seq., and has further prepared <br />maps and plats showing the boundaries and such other information regarding the area in question <br />as required by law; and <br /> <br />WHEREAS, the Community and Economic Development Committee of the Common <br />Council has reviewed said report and recommended to the Common Council that the area <br />qualifies as a Residentially Distressed Area. <br />21 <br /> <br /> <br />
