The Department of Community and Economic <br />Development comments this rezoning would support a neighborhood commercial use and would <br />still be keeping with the zoning of surrounding properties and the mixed-use character of the <br />neighborhood. The Office of Historic Preservation Commission does not have any objections to <br />the change in zoning. The City Engineer had no comment. The property is located within the <br />Edgewater Place Local Historic District. No commitments are proposed. The future land use <br />map identifies this area as a mix of uses. There are no other plans in effect for this area. Along <br />Lincolnway East is a mix of houses and businesses. Some of the structures are in poor condition. <br />The most desirable use is one that is compatible with the mix of uses located in the area. The <br />rehabilitation of this property may have a positive effect on neighboring property values. It is <br />responsible development and growth to encourage the rehabilitation of a building with a use that <br />is compatible with the character of the area. Based on information available prior to the public <br />hearing the staff recommends that the petition be sent to the Common Council with a favorable <br />recommendation. Lincolnway East is a major traffic corridor, with a mix of residential and <br />business uses in the immediate vicinity. This rezoning is compatible with the goals of City Plan. <br /> <br />Ms. Diane Erdman, 621, 625 Lincolnway East, South Bend, Indiana, made the presentation for <br />this bill. <br /> <br />Ms. Erdman advised that she is looking to rezone 621 Lincolnway East to be able to expand <br />sewing machines over there from the back shop where they are presently located. We will <br />basically have sewing machine sales and service. I do have signatures on a petition of those in <br />favor of the rezoning. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this bill, Councilmember Dieter made a motion for favorable recommendation to full Council <br />concerning this bill. Councilmember Varner seconded the motion which carried by a voice vote <br />of nine (9) ayes. <br /> <br />BILL NO. 35-12 PUBLIC HEARING ON A BILL OF THE <br /> COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA, AMENDING THE ZONING <br /> ORDINANCE AND ESTABLISHING HISTORIC <br /> LANDMARK STATUS FOR THE STRUCTURE <br /> AND REAL PROPERTY KNOWN AS THE <br /> AVON THEATRE AND LOCATED AT 307 <br /> SOUTH MICHIGAN, IN THE CITY OF SOUTH <br /> BEND, INDIANA <br /> <br />Councilmember Dieter made a motion to continue this bill until the October 22, 2012 meeting of <br />the Council at the request of the petitioner.
