• <br /> • <br /> Community and Economic Development Committee <br /> May 28, 2002 <br /> Page 2 <br /> Council Member King then called for a presentation on Bill No. 02-47 which is a proposed <br /> resolution requesting the City of South Bend Advisory Commission approve a Community <br /> Revitalization&Enhancement District(CREED). <br /> Ann Kolata made the presentation. She provided a memorandum dated August 22, 2001 (copy <br /> attached) which provided background information on the CREED District addressing procedures, <br /> taxes collected,definitions,acquisition and disposition of property,and the base period. <br /> During Ms. Kolata's presentation she noted that Section II of the proposed resolution is incorrect <br /> since it is including language from Bloomington. She stated that she had approved the form of <br /> resolution before it was filed,but that it would have to be amended. <br /> The Council Attorney requested reference to the filing of committee minutes with the City Clerk's <br /> office as well as their membership. <br /> Council Member King suggested that the resolution be properly amended by the Administration <br /> and heard at the June 10th meeting. <br /> Following discussion, Ms. Kolata requested that Bill No. 29-02 be continued until the Council <br /> meeting of June 10, 2002. <br /> Dr. Varner inquired if the tax levied in a TIF District is part of the frozen levy. <br /> Ms. Kolata stated that it is within the frozen levy if they would choose to levy a tax. Bonds would <br /> be addressed by the Redevelopment Commission thru a bond. She further noted that a GO bond <br /> would be outside of the City's levy. GO bonds may be used as a back-up, but never have been <br /> used this way. <br /> Ms. Kolata then requested that both Bill No. 02-47 and Bill No. 29-02 be continued until the June <br /> 10, 2002 meeting so that she could address then in one Council meeting. <br /> Council Member Ujdak made a motion, seconded by Council Member Kirsits that Bill Nos. 02-47 <br /> and 29-02 be continued until June 10,2002. The motion passed. <br /> Under miscellaneous business, Council Member King noted that the petitioner for Bill No. 02-42 <br /> addressing a ten(10) year real property tax abatement request for the property located at 237 North <br /> Michigan requested for LaSalle Property Management, Co.,Inc. <br /> Mr. Beitzinger then updated the Committee on this item. He noted that he had been in contact with <br /> the Petitioner who advised him that the project is being modified and will be delayed. After that <br /> discussion, the Petitioner requested that their application for abatement consideration be <br /> withdrawn. <br /> Following discussion, Council Member King requested the Council Attorney to prepare a <br /> resolution which would rescind the declaratory resolution adopted earlier by the Council on this <br /> matter. <br /> The Council Attorney noted that the proposed confirmatory resolution on this project should be <br /> struck at this evening's Council meeting, at the request of the Petitioner. <br />
