BILL NO ____ ORDINANCE NO._____________ <br />��� � --- <br />AN ORDINANCE TO AMEND ORDINANCE NO. 111-78, THE <br />SAME BEING AN ORDINANCE DESIGNATING AND <br />�V+ ESTABLISHING AN HISTORIC LANDMARK <br />(19109 Johnson Road) <br />WHEREAS, by its Ordinance No. 111-78, the St. Joseph County <br />Council designated certain real property commonly known as 19109 <br />Johnson Road as an historic landmark; and, <br />WHEREAS, the Historic Preservation Commission of South Bend <br />and St. Joseph County, upon the request of the owner of such <br />property, has requested that such ordinance be amended so as to <br />withdraw the historic landmark designation upon a portion of such <br />real estate; and, <br />WHEREAS, the St. Joseph County Council is of the opinion that <br />the withdrawal of such designation from a portion of that <br />property is in the best interests of the property owner and the <br />citizens of St. Joseph County. <br />NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE ST. JOSEPH COUNTY <br />COUNCIL, THAT: <br />SECTION 1. Ordinance No. 111-78 is hereby amended by <br />deleting therefrom the description of the real estate designated <br />as an historic landmark by such ordinance. <br />SECTION 2. Ordinance No. 111-78 is further hereby amended by <br />adding thereto a new description of real estate designated as an <br />historic landmark, such new description being as follows: <br />A tract of land in the East half of the North <br />Fraction lying North of the Old Indiana Boundary <br />line of Section 36, Township 37 North, Range 2 <br />East, St. Joseph County, Indiana, said tract being <br />more particularly described as follows: <br />Commencing at a point on the North line of said <br />Old Indiana Boundary , 561.45 Feet West of the <br />East line of Said Section 36; thence North <br />00-25'21" West, 455 feet; thence South 90-00'00" <br />West 525 feet; thence South 00-25'21" East 455 <br />feet to the point on the said Old Indiana Boundary <br />line; Thence North 90-00'00" East, 525 feet to the <br />Place of Commencement. Said tract contains 5.484 <br />acres,more or less, and subject to legal highways. <br />The improvements located upon said land can be <br />commonly described as 19109 Johnson Road <br />hereinafter referred to as the "PROPERTY." <br />SECTION 3N. This ordinance shall be in full force and effect <br />from and after its passage and approval as required by law. <br />----------------------------------- <br />Member, St. Joseph County Council <br />
