REGULAR MEETING SEPTEMBER 24, 2012

Councilmember Oliver Davis asked for clarification if we get a letter from our City Attorney.

Council Attorney Kathleen Cekanski-Farrand stated that as the Mayor noted there is a series of
discussions going on to try to negotiate a win/win solution on that situation. She stated that she
was also advised by the City Attorney this morning that she would keep our office advised as to
whether that date is a good date or whether they will need additional time, but she proposed the
th
8.

Jesse Davis, P.O. Box 10205, South Bend, Indiana, stated some concerns regarding the search
for a Director of Public Works and Police Chief. He also voiced concern regarding the
reprimand of Police Office Stilp. He stated that he has concerns about Police Chief Hurley
working for the coroner who works with Metro Homicide. He stated that the Federal Court and
Local Court fighting it out regarding the tapes is just a stall tactic.

Sam Brown, 222 E. Navarre, South Bend, Indiana, had concerns regarding Wal-Mart on Ireland
Road selling guns and ammunition.

Christine Jacobs, 52942 Camellia Dr., South Bend, Indiana, stated she was concerned about Wal-
Mart on Ireland Road selling guns and ammunition.

Greg Brown, no address given, stated concerns regarding Wal-Mart selling guns and
ammunition. He stated that he took a picture of a Wal-Mart employee leaving the gun cabinet
with assault rifles unlocked.

Lawrence Grant, 721 E. Dubail, South Bend, Indiana, commended President Dieter and the
Council for standing up to the administration.

Dale Anderson, 719 W. Ewing, South Bend, Indiana, thanked the Council for their letter to
Prosecutor Michael Dvorak. He stated that however what the prosecutor’s office states and what
he believes happened to his son are like night and day. He stated that there are major
discrepancies, the straw, the chair, and what drug it was. He stated that he would just like to get
to the bottom of this.

Shana Penn, P. O. Box 274 Mishawaka, Indiana, stated that there are contradicting reports
regarding the Michael Anderson case. She asked Dr. Ferlic to contact her to go over what they
have. She stated that she doesn’t think that the City Attorney’s Office, the Prosecutor’s Office or
the Police Department actually understand that I have been given report, that are completely
contradicting what they say. She invited them to sit down with her to see their side of it. She
stated that you will see the information that Ken Cotter provided is either fictitious by way of
information that was provided to him or he is just misinformed. Either which way the
information is not coinciding with information that has been provided to her. She stated that
they have not divulged everything that they have for strategic purposes obviously, but there is
information that will lead you to understand. She stated this family shows up every two weeks
and they are going to continue to show up. She stated that in regards to these tapes, she stated
she doesn’t know when the Mayor is going to finally stand up and start working for the people.
She stated he was elected, she stated that she wasn’t responsible for that. But he was elected and
he was supposed to work for the people, not the prosecutor’s office, not the police, the people.
So when he takes Karen DePaepe and Darryl Boykins out of his position and instead of doing the
right thing and putting them back into their positions, “cause we know damn well that they didn’t
do anything wrong” and then you allow the protecting of the people on the tapes. What he is
failing to realize is that all the people that’s ever called that line are now going to have a claim
against the city. Anybody that called will have a claim against the city because your five people
have a claim against the city. So when is he going to stand up and start doing what is right for
the city instead of his friends that sit behind him.

18
