1 <br />General Provisions Continued <br />DESIGN & BUILD OUTDOOR LIVING SPACES <br />12. Any material or leftover items are property of Custom Outdoor Living. However, we will leave <br />replacement materials for damage control in the future, I.e. 12 to 24 units of each items, if so desires. <br />13. Custom Outdoor Living will not be held responsible for any damage to trees or root damage when <br />Installing pavers near a tree. <br />14. Cleaning and sealing pavers are not required but is recommended by some manufactures. Since products <br />may very there is only a manufacturer warranty with the application. <br />15. Contractor agrees to remove all debris and leave the premises in broom clean condition. <br />16. Estimates only means that this is a good faith estimate on how much a particular item or service may run. <br />Therefore, owner will pay any additional amounts if the bid runs over and that the owner will be refunded <br />if the bid is less than estimate. <br />17. The contractor is not responsible for any underground damage. It is the responsibility of the owner to <br />mark all underground lines in the working area by calling 1-800-382-5544 three working days before we <br />start. (Including underground sprinkler systems.) <br />18. When landscaping plants or trees are not warranted but may be replaced if needed under certain <br />circumstances <br />19. The contractor will provide a copy of liability insurance upon owner request. <br />20. All check payments must be from a local bank. <br />21. When choosing a tumbled product, as your contractor, anything over a 2 inch hole will not be installed as <br />a rule of thumb. <br />22. We will fill in our machine tracks with dirt, anything over and above the tracks are not included in the <br />price. <br />THE CONTRACT PRICE The owner shall pay the Contractor for the material and labor to be performed under the <br />contract the sum of, $13,574.00, subject to additions and deductions pursuant to authorized change orders. <br />PROGRESS PAYMENTS <br />Payments of the contract price shall be paid in the manner following: 25% down for materials, $3,400.00, 25% <br />when we start Job $3,400.00, 50% due upon substantial completion, $6,774.00. I hereby acknowledge that I have <br />read and agree to the terms of this agreement for work contracted and completed and other stipulationssby <br />Custom Outdoor Living.
