Indiana Open Door Law cites four legal justifications for this privacy to be invoked. Having said that,
final action may NOT be taken in Executive Session. Executive Session is generally for purposes of receiving
confidential information.
Without sufficient members available to take action, there really is no meeting anyway, Executive Session
included. Understand this from the extreme... For example, I am myself a voting member of the HPC and
technically a single -member minority. For me, there is never a need for me to advertise an Executive Session
when I have a meeting by myself (committee -of -one). Executive Session should also never be confused with
Executive Committees (for those boards and bylaws that support it).
Nothing other than interview content was discussed. Applicants are NOT HPC board members so I don't
understand what content would have discussed in that forum anyway.
I provided a President's Report at Monday's Regular Meeting. Did you receive one? There were references to
the meetings in question along with the purpose and participants.
-----Original Message -----
From: Catherine Hostetler [mailto:CHOSTETL@co.st joseph.in.us]
Sent: Tuesday, March 16, 2010 3:09 PM
To: Timothy S. Klusczinski
Subject: RE: Executive Sessions in February
I know that you have studied this ruling extensively ---but is a quorum even necessary for an executive
session since it is up to the governing body who to include at the meeting? Also, shouldn't the
memoranda and minutes identify the subject matter considered by specific reference to the enumerated
instance of the law and then certify that no other subject was discussed?
Just curious.
Catherine
Director,
Historic Preservation Commission
of South Bend and St. Joseph
County, Indiana
574 235 9798
>>> 'Timothy S..Klusczinski" <tsk617@gmail.com> 3/16/2010 3:00 PM >>>
There are no Minutes for an interview meeting. The applicants' resumes provided the templates for
the Q & A exchange. Both meetings also fell short of a quorum for the purposes of group action (in this
particular case, "receiving information").
----Original Message -----
From: Catherine Hostetler [mailto:CHOSTETL@co.st joseph.in.us]
Sent: Tuesday, March 16, 20101:01 PM
file://CADocuments and Settings\chostetl\Local Settings\Temp\XPgrpwise\4B9FD143SJC... 3/17/2010
