RESOLUTION NO. 09-02 <br />A RESOLUTION OF THE HISTORIC PRESERVATION COMMISSION OF <br />SOUTH BEND AND ST. JOSEPH COUNTY, INDIANA <br />ESTABLISHING STAFF PROCEDURES <br />WHEREAS, the Historic Preservation Commission of South Bend and St. Joseph County, <br />Indiana (the "Commission") exists and operates under the provisions of ordinances enacted by the <br />Common Council of the City of South Bend, Indiana, and the County Council of St. Joseph County, <br />Indiana (the "Enabling Ordinances"); and <br />WHEREAS, the Commission is empowered, pursuant to the Enabling Ordinances, to adopt <br />and has adopted By -Laws for carrying out the powers and duties.of the Commission; and <br />WHEREAS, the Enabling Ordinances provide that the Commission shall issue a certificate of <br />appropriateness before any one of the following actions is taken: the construction, reconstruction, <br />alteration, demolition or moving of any exterior feature of any building, structure or use; and <br />WHEREAS, a -certificate of appropriateness is not required for the ordinary maintenance and <br />repair of any building, structure or use which'will not involve a change in any exterior features; and <br />WHEREAS, the Commission desires to establish procedures governing the conduct of the <br />Staff of the Commission in order to avoid the Staff exercising powers or duties reserved to the <br />Commission and to provide clear guidelines for the Staff to follow; and <br />WHEREAS, Article 10 of the By -Laws provides the appropriate procedure for amending the <br />By -Laws which requires that approval must be made by a vote of a majority of the Commissioners <br />voting at a regular or special meeting of the Commissioners attended by all of them, provided that no <br />such action shall be taken at a meeting of the Commission attended by less than all of the members <br />unless the members are given at least ten (10) days notice of the substance of the proposed action to <br />be taken at the meeting. The proposed amendment shall be introduced at one meeting and shall be <br />acted upon at the next regular meeting or a special meeting called within at least ten (10) days notice; <br />and <br />WHEREAS, it is desirable that the By -Laws be amended to establish staff procedures forthe <br />conduct of the Staff of the Commission. <br />
