RESOLUTION NO. 09-02 A RESOLUTION OF THE HISTORIC PRESERVATION COMMISSION OF SOUTH BEND AND ST. JOSEPH COUNTY, INDIANA ESTABLISHING STAFF PROCEDURES WHEREAS, the Historic Preservation Commission of South Bend and St. Joseph County, Indiana (the "Commission") exists and operates under the provisions of ordinances enacted by the Common Council of the City of South Bend, Indiana, and the County Council of St. Joseph County, Indiana (the "Enabling Ordinances"); and WHEREAS, the Commission is empowered, pursuant to the Enabling Ordinances, to adopt and has adopted By -Laws for carrying out the powers and duties.of the Commission; and WHEREAS, the Enabling Ordinances provide that the Commission shall issue a certificate of appropriateness before any one of the following actions is taken: the construction, reconstruction, alteration, demolition or moving of any exterior feature of any building, structure or use; and WHEREAS, a -certificate of appropriateness is not required for the ordinary maintenance and repair of any building, structure or use which'will not involve a change in any exterior features; and WHEREAS, the Commission desires to establish procedures governing the conduct of the Staff of the Commission in order to avoid the Staff exercising powers or duties reserved to the Commission and to provide clear guidelines for the Staff to follow; and WHEREAS, Article 10 of the By -Laws provides the appropriate procedure for amending the By -Laws which requires that approval must be made by a vote of a majority of the Commissioners voting at a regular or special meeting of the Commissioners attended by all of them, provided that no such action shall be taken at a meeting of the Commission attended by less than all of the members unless the members are given at least ten (10) days notice of the substance of the proposed action to be taken at the meeting. The proposed amendment shall be introduced at one meeting and shall be acted upon at the next regular meeting or a special meeting called within at least ten (10) days notice; and WHEREAS, it is desirable that the By -Laws be amended to establish staff procedures forthe conduct of the Staff of the Commission.
