ORDINANCE NO. AN -ORDINANCE AMENDING ARTICLE 6.5 OF CHAPTER.2l'OF_THE MUNICIPAL CODE : OF THE CITY -OF SOUTH BEND, INDIANA STATEMENT OF PURPOSE AND INTENT WHEREAS, the County.. of St. Joseph is the site of.several historic landmarks -designated as�.such by the Historic* Preservation Commission of•St. Joseph County in tandem with th'e St. Joseph County Council, and WHEREAS, the procedure for designating landmarks lying in . St. Joseph County outside the City of -South -Bend's territorial limits is substantially the same as for designating landmarks within the City of South Bend, 'and WHEREAS, the City of South Bend has been annexing to.its' boundaries realty which previously lay within St. Joseph County, and WHEREAS, under the existing procedures, landmarks that. previously existed outside City limits must:go through an entire re-landmarking process when they are annexed within City limits, and WHEREAS,.this Ordinance will simplify and assure continuity of historic landmark designations between City and County. .NOW,,THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND; INDIANA; AS -FOLLOWS: SECTION T. Chapter-.21,:Article 1. 6.5, Section 21-117.2 (e)' shall be amended to add a new section (9) to read as follows: (9) Where the Historic Preservation Commission has, designated a historic landmark in Saint Joseph County, and the real estate on which the landmark is situated or -comprised is' subsequently annexed to and brouaht'within the boundaries of the Citv of South Bend, such landmark shall upon annexation to the City of South -Bend-, become a historic landmark of the City of South Bend subject -to reaulation under this Section.,. SECTION II. ,This ordinance -shall be in full force and effect from and after its. passage by the Common Council and approval by the Mayor and publication'of any required notice.
