t. <br />Minutes of the Special Meeting <br />of the <br />Historic Preservation Commission <br />Special Hearing 7th Floor County Commissioner's <br />4:00 p.m. Conference Room, County -City Building <br />March 7, 1995 <br />I. Call to Order <br />The meeting was called to order at 4:00 p.m. <br />II. Roll Call <br />Members present: Mrs. Catherine Hostetler, Mr. John Oxian, Ms. Jewel Van <br />Dalsen, Mrs. Janeanne Petrass, Mr. Jed Eide, Father Richard Bullene. <br />Staff present: Mrs. Aladean DeRose - Legal Counsel, Mr. David Duvall - <br />Director and Ms. Christine Anderson - Administrative Assistant. <br />Members Absent: Mr. Jerry Weiner, Mrs. Joann Sporleder (Leave of Absence), and <br />Mrs. Martha Choitz. <br />Also present: Joe MacHatton, Andrew Greta, Kevin Boughal, Kathy Dempsey, and <br />Kenny Kent. <br />III. Public Hearing <br />A. Certificates of Appropriateness <br />1. 621 Lincolrway East -- EP -LHD -- Porch Repair <br />Mr. Joseph MacHatton informed the Commission he was the owner of 621 <br />Lincolnway East due to reacquiring the building from Kim Pummill, land <br />contract purchaser. He asked that the COA be tabled until he had time to <br />inspect the porch to see what type of repairs were necessary. President Oxian <br />inquired if Mr. MacHatton would be able to have a plan for the Commission by <br />the third Monday in March. Mr. MacHatton said he felt he needed to get <br />together with Mr. Duvall to discuss the matter and that he was not sure when <br />he would be able to do the work. Mr. Duvall stated he believed a new <br />application would need to be filed by the new owner. President Oxian suggested <br />the COA application be withdrawn and Mr. MacHatton could reapply. Commissioner <br />Petrass moved that the COA application be withdrawn and a new application be <br />filed by the new owner. Commissioner Hostetler seconded the motion. The motion <br />Passed unanimouslv. <br />2. 1077 Riverside Drive - - EP -LHD-- Landscaping and light replacement <br />Ms. Anderson read the staff report and the Committee recommendation. President <br />Oxian asked for Legal Counsel DeRoses opinion. She recommended since the <br />parties involved were not in.attendance the Commission should vote as the <br />Committee recommended. Commissioner Bullene inquired why two items were to be <br />tabled. Mrs. DeRose explained the property dispute that was the cause of the <br />items being tabled. Commissioner Petrass inquired if there was a way to get a <br />definitive answer on the property boundary. Mrs. DeRose said she did not <br />believe that was necessary for the Commission to make a determination on <br />whether the proposed changes were appropriate. Mr. Duvall noted the issue that <br />caused the problem was an agreement between the parties that the landscape <br />material to be moved would be tagged. Mr. Duvall explained the plant material <br />was tagged but due to climatic circumstances the tags did not last very long, <br />but the plants have again been tagged. Commissioner Hostetler moved proposed <br />items 1. 2. and 5 be annroved and items 2 and 3 be tabled until the next <br />hearing. Commissioner Petrass seconded the motion.
