This Bid Proposal is further conditioned upon and subject to the following General Conditions unless specifically addressed to the <br />contrary in our Detailed Bid Proposal. A directive to proceed with work shall be interpreted as explicit acceptance of the following: <br />1. Standard Agreement, This proposal shall be the form of the agreement unless supplanted by a Subcontract. Any <br />other contract form will require our review and must be fair to all parties. Where incorporated into a contract, this <br />proposal shall supersede all conflicting terms of such a contract. Unless our Bid Proposal is accepted as offered within <br />30 days, we reserve the option to revise same. <br />2. Exclusions. Unless specifically noted in our Bid Proposal, the following work is not included and must be provided by <br />others: <br />a. Permits, approvals, testing, notifications, monitoring and/or inspection for our work. <br />b. Location, exposure, relocation and/or protection of utilities which could impact our work, including the <br />impact of objects deflected by obstructions or of incorrectly located utilities. <br />C. Acceptable site access and a firm, dry, level, working area negating the need for equipment mats. <br />d. Surveys, layout, field location, grade and as built drawings (if required) for our work. <br />e. All earthwork, including excavation for the lagging, all backfill, and site restoration, spoil removal. <br />f. All water control. <br />g. Relocation of overhead interferences to our work. <br />h. Impact of underground obstructions to our work, we shall be compensated for costs of excavating, removing, <br />or otherwise dealing with such obstructions. <br />i. Impact of existing contamination and pollution to our work, including mold. <br />j. Minority participation including MBE, DBE, RPP, EBE, WBE, etc. <br />k. All traffic control; lane, street or alley closures. <br />I. Once Work has commenced, Work suspension or delay by Contractor or Owner for more than 30 days. <br />m. Performance and Payment Bond, however, same can be provided on a cost reimbursement basis. <br />n. Any items of work not specifically included in this proposal shall not be our responsibility. <br />o. Default or delay in the completion of the work when caused by strike, riot, war, terrorism, Act of God, or <br />other similar circumstances beyond our control. <br />3. Insurance. Insurance we carry includes Statutory Workers Compensation with Jones Act and/or Longshoremen & <br />Harbor workers Coverage, $1 Million General Liability with Completed Operations Coverage, and $2 Million Auto <br />Liability. Additional Insurance and/or Endorsements can be provided on a cost reimbursement basis, including Builders <br />Risk, Railroad, Additional Insured Endorsements on form CG2010 and Additional Insured Endorsement for Completed <br />Operations. We do not agree to be responsible for OCIP or Builder's Risk deductibles or SIR's - regardless of fault. This <br />limitation shall prevail over any indemnification provisions that may be set forth in the Subcontract. If the Owner, <br />Construction Manager or General Contractor elects to provide the insurance for a project, we require that it meet or <br />exceed our standard coverage and that any exclusions and/or deductibles become the responsibility of the provider <br />regardless of fault and notwithstanding any indemnification provisions in any Contract. <br />
