REGULAR MEETING February 25, 2019 <br /> plan that shows the area is three-hundred(300)feet away from residential.Anything past that point <br /> is where we are actually doing the storage. Under the requirements for the Zoning Ordinance, <br /> anything close to residential at that point would have to screen the height of the storage material <br /> and it could not be higher than the screening fence which in that case would be ten (10) feet. <br /> Anything behind that line goes to the height of the zoning requirement which is one hundred fifty <br /> (150)feet,fifteen(15)stories. We are holding it to thirty(30)feet which is what we said we would <br /> do as part of a written commitment. There was a question from a Councilmember about whether <br /> you could see that thirty (30) foot height of that material. If you were traveling down Sample <br /> Street, I gave Councilmember Broden a crude sketch. I took a look at the height of the building, <br /> the location of the closest aggregate pile that would be there, and you would not be able to see it <br /> driving down Sample Street, the height of that material. There was a question from one (1) of the <br /> owners about where the access point would be. It is in the northwest corner of the site and we are <br /> not changing that. There would be only one (1) access point, we would have solid screens along <br /> the western and eastern portions of the site. The existing wooded areas that are part of the site <br /> would remain, which would also provide some additional screen for this. <br /> Councilmember Jake Teshka asked, You said that the thirty(30) foot was submitted in writing? I <br /> don't have that. <br /> Mr. Danch replied, Yes. We said we would do that as a written commitment for the Council, even <br /> though we're not required to do that by zoning. <br /> Councilmember Jake Teshka stated,To me,it seems like an inherently County operation. Not only <br /> are we talking about the thirty (30) foot high piles, but the dump trucks in and out and front-end <br /> loaders. Is there a reason why they want to be at that location? <br /> Mr. Danch replied,Yes. One(1)of the reasons is that it is already zoned properly with the GI, and <br /> this particular location on Sample Street is already an industrial area, and it allows them access to <br /> Laporte County. The one (1) they have on McKinley is a completely different zoning category. <br /> Their materials, the piles would be located closer to the property line. The piles can be up to fifty <br /> (50)feet tall at that location,that's County zoning. They just wanted somewhere closer. They have <br /> jobs here in the City of South Bend where they deliver materials to, and also in Laporte County. <br /> So, it makes sense from a traveling standpoint to have a second (2'1) location. When you were <br /> asking whether other areas in the City of South Bend have this, Kuert Concrete does exactly the <br /> same thing. Since they have been there for so long, they don't have to go through this process <br /> unless they decide to expand. They are up against residential, we're actually against only <br /> industrial. <br /> Councilmember Regina Williams-Preston stated, I think you might have answered it but someone <br /> brought us pictures earlier which you had a chance to see, and it looks horrible. I thought, Oh my <br /> God, I don't want that anywhere near where I live, and you're saying that fifty (50) feet is their <br /> limit, and you said that is different? <br /> Mr. Danch replied, It is. That particular site went through a rezoning process. They were allowed <br /> different operational standards there, so the piles that you see were allowed to be there. That was <br /> a completely different operation. That is a thirty (30) to forty (40) acre site that you are seeing <br /> there, as compared to one (1) that is only about nine (9) acres. And the site over there is actually <br /> on sand, they weren't required to put pavement in. Whereas, this particular one (1) we have a <br /> smaller site, and any materials that are there are going to be on pavement. Drainage will be to City <br /> standards, there wouldn't be any runoff from this site on to any adjacent property. There would be <br /> no contamination and there are no liquids that go with this. The question about the aggregate <br /> material, there would be dust, but they would water down those aggregate materials to keep the <br /> dust down. <br /> Councilmember Regina Williams-Preston asked, You said they would water it down on a regular <br /> basis? <br /> Mr. Danch replied, They do for processing, yes. And the processing we talked about here is only <br /> for a period of five(5) weeks out of an entire year. <br /> Councilmember Regina Williams-Preston asked, Did they check any properties closer to Laporte, <br /> like out that way towards the County? <br /> 45 <br />
