REGULAR MEETING JULY 9, 2012 <br /> <br /> <br /> <br /> <br /> <br />BILL NO. 24-12 PUBLIC HEARING ON A BILL OF THE <br />COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, AMENDING CHAPTER 13, <br />ARTICLE 6 ADDRESSING AIR POLLUTION <br />CONTROL OF THE SOUTH BEND MUNICIPAL <br />CODE BY THE INCLUSION OF NEW <br />SECTIONS 13-76 THROUGH 13-77 <br />ADDRESSING CLEAN AIR STANDARDS FOR <br />WORKPLACES AND PUBLIC PLACES <br /> <br />Councilmember Dieter made a motion to continue this bill until the July 23, 2012 <br />meeting of the Council. Councilmember Varner seconded the motion which carried by a <br />voice vote of nine (9) ayes. <br /> <br /> <br />BILL NO. 28-12 PUBLIC HEARING ON A BILL OF THE <br />COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, AMENDING CHAPTER 13, <br />ARTICLE 5, SECTION 13-75.5 DISORDERLY <br />HOUSES PROHIBITED BY THE INCLUSION <br />OF NEW SUB-PARAGRAPHS l, m, and n TO <br />PARAGRAPH (a) (5) OF THE SOUTH BEND <br />MUNICIPAL CODE <br /> <br />Councilmember Dieter made a motion to accept the substitute version of this bill. <br />Councilmember Varner seconded the motion which carried by a voice vote of nine (9) <br />ayes. <br /> <br />Councilmember Fred Ferlic, Chairperson, Health & Public Safety Committee reported <br />that this committee held a meeting this afternoon and it was the consensus of the <br />committee to send this substitute bill to the full Council with a favorable <br />recommendation. <br /> <br />Councilmember Tim Scott, 711 Forest Avenue, South Bend, Indiana, made the <br />presentation for this bill. <br /> <br />Councilmember Scott advised that this bill is aimed at strengthening our Disorderly <br />House regulations. The bill adds prostitution, racketeering, drug dealing, and criminal <br />gang activities. He stated that he believes this bill will provide additional enforcement <br />tools for the City Administration which are not only reasonable, but necessary. <br /> <br />th <br />Aladean DeRose, Interim City Attorney, 14 Floor County-City Building, 227 W. <br />Jefferson Blvd., South Bend, Indiana, stated that she was speaking on behalf of Assistant <br />City Attorney Ann-Carol Nash. She stated that Ms. Nash is in favor of this bill. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Dieter made a motion for favorable <br />recommendation to full Council concerning this substitute bill.
