REGULAR MEETING JULY 23, 2012 <br /> <br /> <br /> <br /> <br />Councilmember’s Schey, Dr. Fred Ferlic and Gavin Ferlic, all advised that they won’t be <br />supporting this bill. They believe that there is more work that needs to be done on this, <br />and will be working towards a more comprehensive bill. <br /> <br />Council Attorney Kathleen Cekanski-Farrand stated that at this stage the City Code calls <br />for questions from the Council as opposed to statements. <br /> <br />Oliver Davis stated that he will be supporting this bill. He stated that he doesn’t believe <br />this bill will add any extra costs on the businesses. He stated that the information can be <br />down loaded. He stated that if a business wants a fancier download they can go ahead <br />and do that themselves and that is their choice to do that. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Scott made a motion for favorable <br />recommendation to full Council concerning this bill. Councilmember Henry Davis, Jr. <br />seconded the motion which carried by a voice vote of six (6) ayes and three nays <br />(Councilmember’s Schey, Dr. Fred Ferlic and Gavin Ferlic.) <br /> <br /> <br />BILL NO. 24-12 PUBLIC HEARING ON A BILL OF THE <br />COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, AMENDING CHAPTER 13, <br />ARTICLE 6 ADDRESSING AIR POLLUTION <br />CONTROL OF THE SOUTH BEND MUNICIPAL <br />CODE BY THE INCLUSION OF NEW <br />SECTIONS 13-76 THROUGH 13-77 <br />ADDRESSING CLEAN AIR STANDARDS FOR <br />WORKPLACES AND PUBLIC PLACE <br /> <br />Councilmember Scott made a motion to continue this substitute bill indefinitely. <br />Councilmember Schey seconded the motion which carried by a voice vote of nine (9) <br />ayes. <br /> <br />Councilmember Oliver Davis asked the Council attorney for clarification on how a bill is <br />continued indefinitely and how it comes back to the Council. <br /> <br />Council Attorney Kathleen Cekanski-Farrand stated that when a bill is continued <br />indefinitely it is must appear under unfinished business at a future Council meeting. At <br />that point the Council by majority votes set it for a date specific for Public Hearing. <br /> <br />Councilmember Oliver Davis stated that it would have to receive five (5) votes for it to <br />come back to the Council. What happens if the bill does not receive five (5) votes? <br /> <br />Council Attorney Kathleen Cekanski-Farrand stated that the bill stays in committee. <br />Typically, if a bill is still pending in committee, the City Clerk’s Office brings it to the <br />attention of the Council at the first meeting following the organizational meeting in <br />January and the Council by majority vote determines what they want to do. <br /> <br /> <br />RISE AND REPORT <br />Councilmember Scott made a motion to rise and report to the full Council. <br />Councilmember Varner seconded the motion which carried by a voice vote of nine (9) <br />ayes. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> 9 <br /> <br />
