<br /> <br /> <br />REGULAR MEETING MAY 29, 2012 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />RESOLVE INTO THE COMMITTEE OF THE WHOLE <br />At 7:45 p.m. Councilmember Scott made a motion to resolve into the Committee of the Whole. <br />Councilmember Varner seconded the motion which carried by a voice vote of nine (9) ayes. <br />Councilmember White, Chairperson, presiding. <br /> <br />Councilmember White, explained the procedures to be followed for tonight’s meeting in <br />accordance with Article 1, Section 2-11 of the South Bend Municipal Code. <br /> <br />Councilmember White stated that a brochure may be found on the railing in the Council <br />Chambers explaining those procedures. <br /> <br />PUBLIC HEARINGS <br /> <br />BILL NO. 08-12 PUBLIC HEARING ON A BILL OF THE <br /> COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA, ANNEXING TO AND <br /> BRINGING WITHIN THE CITY LIMITS OF <br /> SOUTH BEND, INDIANA, AND AMENDING <br /> THE ZONING ORDINANCE FOR PROPERTY <br /> LOCATED IN CLAY TOWNSHIP, <br /> CONTIGUOUS THEREWITH; COUNCILMANIC <br /> DISTRICT 4, DOUGLAS ROAD LAND <br /> PARTNERS SOUTH, LP, 17201 DOUGLAS <br /> ROAD <br /> <br />Councilmember Oliver Davis, Chairperson, Zoning & Annexation Committee reported that this <br />committee met this afternoon on the bill and sends it to full Council with a favorable <br />recommendation. <br /> <br />th <br />Larry Magliozzi, Assistance Director, Area Plan Commission, 11 Floor County-City Building, <br />227 W. Jefferson Blvd., South Bend, Indiana, presented the report from the Commission. <br /> <br />Mr. Magliozzi advised that the petitioner is requesting a zone change from R Single Family <br />District (County) to CB Community Business District (City) to allow uses allowed in CB <br />Community Business District. The site is vacant. To the north is Memorial Home Care zoned <br />CB Community Business District (South Bend) To the east is a vacant outlot, part of the Brown <br />Mackie College campus and a dentist office zoned CB Community Business District (South <br />Bend.) to the south is a retention area for Brown Mackie College zoned CB Community Business <br />District (South Bend) To the west are single family homes, zoned R Single Family District <br />(County.) The “CB” Community Business District is established to provide a location for high <br />volume and high intensity commercial uses. Activities in this district are often large space users <br />which may include limited amounts of outdoor sales or outdoor operations. The total area is 0.75 <br />acres. There is a 3,830 square foot building proposed, covering 12% of the site. The proposed <br />33 parking spaces, along with drives cover 44% of the site. The remaining 44% is open spaces. <br />Access will be through the Brown Mackie site via an ingress/egress easement provided on the <br />Douglas road partners Minor Subdivision. The Brown Mackie site to the east was annexed in <br />2001 and most recently rezoned in 2009. A subsequent subdivision in 2009 created two outlots <br />along Douglas Road. Other recent activity in the area include Memorial Home Care, to the <br />north, annexed in 2002 and rezoned in 2002 and 2005 and Horizon Bank, at the corner of <br />Douglas and State Road 23, rezoned in 2009. Douglas Road is a four lane road with dedicated <br />left turn lanes at the signaled intersections with State Road 23 and the entrance to Brown <br />Mackie/Memorial Home Care. The site will be serviced by municipal sewer and water. The <br />City’s Annexation Planner notes the annexation is 75.8% contiguous to the existing city limits, <br />and City services, including water and sewer, can be made available. Therefore the project <br />meets the requirements for annexation. No commitments are proposed. The rezoning is <br /> 11 <br /> <br />
