LOCAL SEWER Ilu11_'ROVEMENT RESOLUTION NO. 594. RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, COUNTY OF ST. JOSEPH, STATE OF INDIANA, That 'the .construction of a local sewef, intended and adapted only for local use by the property holders whose property abuts thereon, and not `intended °or adapted for receiving sewerage from' collateral drains, be and the same is, hereby ordered in anal -along Lindsey Street from Portage Avenue to Allen Street, as follows, towit:- Beginning at the intersection of th center line of Leland Avenue and Lindsey.Street;. thence vast along the center line- of Lindsey Street to a point 33 feet west -of thet Westerly line of Portage Avenue with a 10 inch - - ,itriffied pipe sewer.. Also; Beginning at the intersection -of the center line of -.S(cott Street and Lindsey Street; thence west along the center ,line of Lindsey Street to a point 70 feet cast of the. -east line of Cushing Street with a 10 inch vitrified pipe sewer, -Also Beginning at the intersection -of the center line of Harrison Avenue anal ,Lindsey Street; thence east along the center line of Lindsey: -Street to a point 78; feet, west_ of tha 'west• line of Cottage Grove -Avenue with a 19 inch vitrified pipe_. sew -or., Also; _:beginning -at the-, intersectionsof the _eefiter line:)of Sherman ,Avenue -viand,-L-indsey .Street; thence eastk along the center line= of Lind. -bey Street to a point- 80 feet west of the' west line of Harrison Avenue with a 19 -inch vitrified pipe sewer,. - Also; Beginning at the intersection .of the center line of Sherman Avenue and Lindsey Street; thence west along the center line of Lindsey Streetto a point 80 feet eadt of the Beast line --of Allen Street with a' 10 inch vitrified pipe sewer. Together -with the necessary manheles, storm Water inlets, conduits, flush --tanks and house con- nections to the curb line' 'along the' l irie of said improvement, all as is more part i- eularly °shown and all -in accordance withiplans, prof ilea, detail drawings and spec i- f ica ions --on `file in the office of the Department of Public Works of the City of South, Bend, IndIana, and said'sewer withlall its appurtenances shall be constructed in.. accordance with the profile and specifications now` on file in the office=of the -- Department of Public Works of said City. The cost of said improvement -shall be apport,foned against and paid by the property holders whose property -abuts thereon, and upon the Ci-6y-of South Bend if the City is benefitted by said improvement, ,ail according to the method and manner provided'yfor by in Act of the General. Assembly of tY a State bf Indiana, entitled`-" An Act Concerning Municipal CorpoPat ione, "- approved March (5,1905. Assessments, if deferred, are to be paid )in ten equal annual installments, with interest at the rate of six per cent per annum. A bnnd or bonds are issued. Under no circumstances shall the City of South Bend be or be held `responsible for any sum or sums due from said property owner or ownwra for said work, or for the collection of same, or for the payment of airy bond or bonds, certificate or certificates, issued to said contractor in payment for such work, except for such money's as shall have been actually received by the City from the assessments.for such improvement, or such moneys as said City is by said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement, assessment of property, collections of assessments and issuance of bonds therefore shall be as provided .far in said above entitled Act:. Notice of --this resolution shall be published on the 15th. , day -of January 1919 and on the 22dd., day of January 1919 in the South Bend Daily Tribune. This Board will give a hearing on this resolution at its office in the City Hall cn the 5th.l, day of Februar.# 1919. at 7:15 P.M.. Adopted this 14th., day of January 1919 G. A.
