REGULAR MEETING January 14, 2019 <br /> Councilmember Regina Williams-Preston then made a motion to continue Bill No. 61-18 until the <br /> May 13`h, 2019 meeting of the South Bend Common Council. Councilmember Oliver Davis <br /> seconded this motion but then removed his seconding of the motion. This motion then failed due <br /> to the lack of a second. <br /> Councilmember Gavin Ferlic then made a motion to send Bill No. 61-18 to the full Council with a <br /> favorable recommendation. Councilmember Jo M. Broden seconded this motion which carried by <br /> a roll call vote of six(6)ayes and three(3)nays(Councilmember Regina Williams-Preston, Sharon <br /> L. McBride, Oliver Davis). <br /> 67-18 PUBLIC HEARING ON AN ORDINANCE OF <br /> THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA AMENDING ONE <br /> SUB-PART EACH OF SECTIONS 13-126 AND <br /> 13-127, CHAPTER 13, ARTICLE 11 OF THE <br /> SOUTH BEND MUNICIPAL CODE, BY <br /> REMOVING CERTAIN RESTRICTIONS ON <br /> TATTOO PRACTITIONER AND PREMISES <br /> LICENSING <br /> Councilmember Gavin Ferlic, chair of the Community Investment Committee, reported that they <br /> met this afternoon and,due to the lack of a quorum,send this bill forward with no recommendation. <br /> Michelle Adams, Business License Administrator for the Department of Community Investment <br /> with offices located on the 14th floor of the County-City Building, South Bend, IN, served as the <br /> presenter for this bill. Ms. Adams stated, I'm here this evening on behalf of the City to request an <br /> amendment to the Tattoo Establishment and Artist Ordinance, Chapter 13,Article 11, sections 13- <br /> 126 and 13-127 which prohibits issuing a license to a person who have been convicted of a felony <br /> or who have been convicted of drug or alcohol violations. These restrictions can prevent a now <br /> law-abiding and deserving applicant from operating a business in South Bend and making a gainful <br /> living. The City is trying to take into consideration that a felony and an alcohol related criminal <br /> conviction may have little to no relevance to the specialized practice of tattoo artistry and that an <br /> approval or denial should not be solely based on past criminal convictions. These types of <br /> restrictions do not apply to all South Bend business licenses. Some examples would be arborist, <br /> auto repair,restaurants and peddlers,all do not have these restrictions.Also,the City of Mishawaka <br /> Indiana removed these criminal conviction restrictions from their tattoo ordinance on April 3rd, <br /> 2017. The St. Joseph County Health Department permits them, as well, but does not do criminal <br /> background checks. For these reason, the City would like to have the Tattoo Establishment and <br /> Artist Ordinance amended to allow fair and equitable treatment of all citizens which desire and <br /> deserve to operate a business in the City of South Bend. <br /> Councilmember John Voorde then opened the floor to questions and comments from Council <br /> Members. There were none. <br /> This being the time heretofore set for the Public Hearing on the above bill, proponents and <br /> opponents were given an opportunity to be heard. There were none. <br /> Councilmember Gavin Ferlic made a motion to send Bill No. 67-18 to the full Council with a <br /> favorable recommendation. Councilmember Oliver Davis seconded this motion which carried by <br /> a voice vote of nine (9) ayes. <br /> 68-18 PUBLIC HEARING ON AN ORDINANCE OF <br /> THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, APPROVING THE <br /> CITY OF SOUTH BEND'S UPDATES TO THE <br /> CITY'S 2013 ADA PLAN FOR PEDESTRIAN <br /> FACILITIES IN THE PUBLIC RIGHT OF WAY <br /> AND ITS TITLE VI PLAN FOR NON- <br /> DISCRIMINATION IN CITY SERVICES, <br /> 19 <br />
