REGULAR MEETING December 10, 2018
meeting discussion which was to respond to Councilmember Broden's question about the amount
of those trust funds at the time the trust was dissolved. I went back to confirm and that number
was $455,518.43. The wire transfer that handed those funds over from Key Bank, as the former
trustee, to the City was received here by the City on October 15, 2018 of that amount. I would be
happy to answer any further questions about this. There are, basically, two (2) purposes in mind
with this ordinance. On one(1) hand, in order to protect and properly manage those funds that are
now in the City's hands to establish what is Fund #731 which is the new fund distinct for the
Bowman Cemetery. On the other hand it does some clean-up of the substantive cemetery
maintenance provisions within our municipal code to ensure those are consistent with State law.
This being the time heretofore set for the Public Hearing on the above bill, proponents and
opponents were given an opportunity to be heard. There were none.
Councilmember Tim Scott made a motion to send Bill No. 66-18 to the full Council with a
favorable recommendation. Councilmember John Voorde seconded this motion which carried by
a voice vote of nine (9) ayes.
RISE AND REPORT
Councilmember Karen White made a motion to rise and report to full Council. Councilmember
Jake Teshka seconded the motion which carried by a voice vote of nine(9) ayes.
REGULAR MEETING RECONVENED
Be it remembered that the Common Council of the City of South Bend reconvened in the Council
Chambers on the fourth floor of the County-City building at 8:10 p.m. Council President Tim Scott
presided with nine(9)members present.
BILLS —THIRD READING
BILL NO.
55-18 THIRD READING ON AN ORDINANCE OF
THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, AMENDING,
CHAPTER 14 OF THE SOUTH BEND
MUNICIPAL CODE BY THE INCLUSION OF
NEW ARTICLE 14 ENTITLED SPECIAL EVENT
ON PUBLIC PROPERTY REGULATIONS
Councilmember Karen White made a motion to accept the second (2"d) Substitute version of Bill
No. 55-18. Councilmember Gavin Ferlic seconded this motion which carried by a voice vote of
nine (9) ayes.
Councilmember Gavin Ferlic made a motion to adopt Substitute Bill No. 55-18. Councilmember
Karen White seconded this motion which carried by a roll call vote of nine(9) ayes.
61-18 THIRD READING ON AN ORDINANCE OF
THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, AMENDING
CHAPTER 17 OF THE SOUTH BEND
MUNICIPAL CODE TO ADD A NEW ARTICLE
14 ESTABLISHING INTERIM STORM WATER
UTILITY RATES AND AMENDING CHAPTER
2, ARTICLE 14 TO CREATE A NEW FUND FOR
THESE REVENUES TO BE KNOWN AS THE
STORM SEWER FUND (#667)
This bill is continued to the January 14th, 2019 meeting of the South Bend Common Council.
13
