REGULAR MEETING October 22, 2018 <br /> At 7:24 p.m. Councilmember Karen White made a motion to resolve into the Committee of the <br /> Whole. Councilmember John Voorde seconded the motion which carried by a voice vote of nine <br /> (9) ayes. Councilmember Gavin Ferlic, Chairperson, presiding. <br /> Councilmember Gavin Ferlic explained the procedures to be followed for tonight's meeting in <br /> accordance with Article 1, Section 2-11 of the South Bend Municipal Code. <br /> PUBLIC HEARINGS <br /> BILL NO. <br /> 53-18 PUBLIC HEARING ON AN ORDINANCE <br /> AMENDING THE ZONING ORDINANCE AND <br /> SEEKING A SPECIAL EXCEPTION USE FOR <br /> PROPERTY LOCATED AT 121 EAST TUTT <br /> STREET, COUNCILMANIC DISTRICT NO. 2 IN <br /> THE CITY OF SOUTH BEND, INDIANA <br /> Councilmember Oliver Davis, chair of the Zoning and Annexation Committee, reported that they <br /> met this afternoon and send this bill forward with a favorable recommendation. <br /> Angela Smith,Deputy Director of the Area Plan Commission with offices located on the 11th floor <br /> of the County-City Building,South Bend,IN,served as the presenter for this bill.Ms. Smith stated, <br /> Before you is a petition to rezone from LI, Light Industrial to MU, Mixed-Use and seeking a <br /> special exception for a group residence at the property highlighted here (referencing a slide in a <br /> presentation which is available in the City Clerk's Office) in red. The existing area is a mixture of <br /> Light Industrial and Mixed-Use as your front on Michigan Street. The existing property is a vacant <br /> industrial warehouse that is planned to be used and converted for the Weather Amnesty which <br /> calls under the group residence category. The site plan does not propose any significant changes <br /> also it does show the required landscaping that would be required per the current ordinance. This <br /> comes to you from the Area Plan Commission with a favorable recommendation and I would be <br /> happy to answer any questions. <br /> David Vanderveen,Hope Ministries with offices located at 432 South Lafayette Boulevard, South <br /> Bend, IN, served as the petitioner for this bill. Mr. Vanderveen stated, So we are hoping to use this <br /> building for Weather Amnesty services this winter. As you know, we have provided Weather <br /> Amnesty in this community for many years and it is a service we need to provide to keep the folks <br /> who are living on our streets safe and warm in the coldest nights of the year. So we propose <br /> providing services for both men and women in this building which is needed this year. We will be <br /> working in conjunction with the Center for the Homeless who will also be involved in the Weather <br /> Amnesty program. Weather Amnesty services are available to people from 8:00 p.m. to 8:00 a.m. <br /> each evening from November 1st, 2018 through April 1St, 2018. <br /> Pam Meyer, Director of Neighborhood Development for the Department of Community <br /> Investment with offices on the 14th floor of the County-City Building, South Bend, IN, stated, I <br /> just wanted to clarify the conversation. While we understand that the rezoning to the MU, Mixed- <br /> Use is not temporary, the Weather Amnesty period is temporary. As part of that, the City has <br /> agreed with the property owner to facilitate the rezoning process back to Light Industrial at the <br /> end of the Weather Amnesty period. You had asked for a copy of the agreement and it was emailed <br /> to you and you also have a paper copy. The emailed copy does have both signatures. <br /> Councilmember Jake Teshka stated, I just want to clarify. So within sixty (60) days after the <br /> expiration of the lease, which I think in Committee David had said was April 15th, the City or the <br /> Department of Community Investment has entered into an agreement that we will rezone that back. <br /> Ms. Meyer replied, We will file an application with the property owner's signature, as we did this <br /> time and go through this same process. <br /> Councilmember Jake Teshka followed up, So DCI will initiate that? <br /> Ms. Meyer replied, Yes. <br /> 5 <br />
