Councilmember Oliver Davis <br />seconded the motion which carried by a voice vote of nine (9) ayes. <br /> <br /> <br />BILL NO. 31-11 PUBLIC HEARING ON A BILL OF THE <br />COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, APPROVING BLOCK PARTY <br />APPLICATIONS FEE <br /> <br />Councilmember Dieter made a motion to hear the substitute version of this bill. <br />Councilmember Oliver Davis seconded the motion which carried by a voice vote of nine <br />(9) ayes. <br /> <br />Councilmember LaFountain, Chairperson, Personnel & Finance Committee reported that <br />this committee held a Public Hearing on this bill this afternoon and sends it to the full <br />Council with a favorable recommendation. <br /> <br />th <br />Aladean DeRose, Chief Assistance City Attorney, 14 Floor County-City Building, 227 <br />W. Jefferson Blvd., South Bend, Indiana, made the presentation for this bill. <br /> <br />Ms. DeRose advised that with the most helpful cooperation and assistance of City <br />Council Attorney Kathleen Cekanski-Farrand this substitute bill approving block party <br />application fees is based on two core concerns. The first is that residential block parties <br />which are not for a private event like a birthday party should be permitted and second that <br />the City should recoup a portion of its actual costs when it closes a public street to <br />accommodate a block party. She stated that the bill also set two application fees: <br />$125.00 for non-residential block parties and $50.00 for residential block parties. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Oliver Davis made a motion for favorable <br />recommendation to full Council concerning this bill as substitute.
