®CITY OF SOUTH BEND I OFFICE OF THE CLERK <br /> I wanted to have the update because it almost goes back to the similar situation we had with the <br /> parks.On August 3rd,2018,there was an article in the South Bend Tribune and I shared my positive <br /> views that I can see benefits of having it in the City. The City of Mishawaka has theirs. The issue <br /> I had is that we are already discussing the budget. People were asking if this is a budget issue and <br /> if we should have this as a budget session. My point on that is,prior to it even becoming a budget <br /> issue, the ordinance should have come before our Committee, the Zoning and Annexation <br /> Committee, so we could have a discussion on it. Then after we have that discussion and have the <br /> votes on that, then it goes to a budget Committee for us to approve the budget. We've had all this <br /> time talking about the budget and yet there is no clear understanding on what the ordinance is. <br /> Unless I missed the ordinance. Was there an ordinance already on this? <br /> Councilmember Tim Scott stated, It was only just discussed in the budget. <br /> Committee Chair Davis stated, My point of issue is, before it goes, where I am is similar to the <br /> same thing we had with Historic Preservation. These things of significant nature where this has <br /> been the same thing since 1966, any significant kind of a situation should have been discussed <br /> within our Committee. And then after it gets the blessings and all that, it goes into the budget. For <br /> us to approve the budget and all that kind of stuff and then come back to it because I didn't see it <br /> on any of the reading. There hasn't been a first(1St) reading of it so it has to have at least the first <br /> (1 st) reading on October 8th, 2018. That means it would be voted on the same day we approve the <br /> budget. So in essence, we will be dealing with an ordinance after we've already approved the <br /> budget. As the Chair of this kind of thing, the Ordinance should have come prior to us budgeting <br /> for it. I shared this, we had an Area Plan meeting, and I shared my concerns regarding this at the <br /> meeting because of the fact that I publically stated I see the reason for it but I had no anticipation <br /> of that. That was August 3rd, 2018 and we are now at September 24th, 2018 and no ordinance has <br /> come before us.I have great concerns of this being in a budget when we have not had the discussion <br /> for it. I see the reason why we need to have it but I would just like to have that ordinance because <br /> there are a couple things we need to look at. <br /> He continued Number one 1 we need to look at the structure of the group. Mishawaka has nine <br /> (9) on that group. Out of that nine (9) they have one (1) representative. Will the Mayor appoint <br /> eight (8) and we appoint one (1)? Is it in the Department of Community Investment? Is it tilted <br /> that way? We need to ask that question. My initial thought when it came up is that we could <br /> consider something similar to how TRANSPO's Board is set up. The Mayor has three (3), the <br /> Council has four(4),that's seven(7)but whoever does the other two (2)really doesn't matter. It's <br /> just the fact that I don't know who reports that so we need to look at that. Staff members,we need <br /> to figure out how that will all work out from that standpoint. Times of the meetings, Mishawaka <br /> has theirs on the second(2nd)monthly Tuesday at 7:00 p.m. and I want to make sure we have ours <br /> in the afternoon hours. Again, we need to discuss that because a lot of our City meetings such as <br /> Board of Public Safety is in the morning. We need to be able to have that where that would be <br /> written and that would be in that standpoint.And so,again,with it being housed within Community <br /> Investment,would there be a check and balance kind of thing? <br /> Councilmember Tim Scott stepped out of the meeting at 5:44 p.m. <br /> Committee Chair Davis went on, There were some concerns of the oversight that some people <br /> have shared with me. It's nice to have had some of the outside groups to look at what we are doing <br /> to take all onus off us when it comes to those kinds of things.
