<br /> MR. MIKE DANCH: Danch, Hamer&Associates, 1643 Commerce Drive, South Bend, Indiana,
<br /> representing the petitioner the City Redevelopment Department. Mainly what we're doing here is this is the
<br /> neighborhood area that's bounded by Lincolnway East, South Street and Rush Street. These properties were
<br /> acquired by the Redevelopment from the South Bend Housing Authority. Basically what the Redevelopment
<br /> Authority would like to be able to do is to put these properties back up for sale for either single ownership,
<br /> duplexes or the multi family classification. What we ran into, we had discussions with the Area Plan •
<br /> Commission staff and the Building Department, the houses that you see on our site plan are the existing
<br /> ones. A couple of these houses right now are being used as single family. The other ones are being used as
<br /> multi family. What happens is under the zoning for"MFI"you're not allowed to have a single family
<br /> residence. So what we're trying to do is work with the City of South Bend to make these properties sellable
<br /> and provide enough options for the city that if someone wants to buy these homes they would have the
<br /> option to continue to use them as duplexes,the ones that are that way, or single family depending on how
<br /> that worked out. When we went through the zoning ordinance I had to ask for Special Exceptions to be
<br /> allowed to use the houses as single family under"MFI". That's not a permitted use under"MF 1"unless you
<br /> get the Special Exception approved. The other variances that were asking for are basically for the setbacks
<br /> to recreate and reconfigure property so that I can go through the subdivision process through the plat
<br /> committee to create Iegal lots of record for each of the houses. What we ran into is that the houses are they
<br /> way they have been separated previously,I'm going to assume that it wasn't done with surveys, that there
<br /> were encroachments of buildings,walkways onto the adjacent properties, so the diagram that you see before
<br /> you would be also the subdivision,that's what it would look like and we've submitted it to the Area Plan
<br /> Commission for approval. I've tried to clean up all the problem areas that were adjacent to theses houses.
<br /> And what we did is we went through the ordinances one by one to figure out if we had sidewalks that I
